the aforesaid Day in the sum of four pounds four Shillings and ten pence Curr.^t money of Maryland
for divers Goods Wares and Merchandizes by the af.^d Day unto the af.^d William Wye at his
special Instance and Request before that time there sold and delivered as by an Account
thereof here in Court ready to be produced may appear And so thereof being Indebted the
af.^d William Wye afterwards to witt the af.^d twenty first day of Jannary in the year
of our Lord God Seventeen hundred and thirty four af.^d at the County af.^d in Consideration
thereof upon himself did assume and unto the same Day then and there faithfully did
promise that he the af.^d William Wye the af.^d sum of money unto the af.^d Day when
thereof afterward he should be required well and faithfully ^would^ pay and Content Nevertheless
the af.^d William Wye his promise and Assumption af.^d nothing regarding
but minding and fraudulently Intending the af.^d Day in this part Craftily and Subtily
to deceive and defraud the af.^d Sum of money or any part thereof unto the same day
hath not paid nor for the same in any sort Contented altho' to do the same by the af.^d
Day afterwards to witt the tenth Day of August in the year of our Lord God
Seventeen hundred and thirty five at Somerset County af.^d the af.^d William Wye was
required but that unto him hitherto ^to^ pay or in any Sort to content altogether hath
refused and Still refuse to the Damage of the same day Nine pounds like money
and five hundred pounds of Tobacco And thereupon he bringeth Suit &.^c

And the said William Wye by William Beckingham his attorney Cometh and defendeth the force and
Injury when &.^a and prays Leave thereof to Imparle hereuntill next Court and he hath it and the Same
day is given to the afd Day Scott here also &^a

Att which said next Court to witt the Sixteenth day of march ann^o Dom One thousand Seven
hundred and thirty five Came againe as well the afd Day Scott as the afd William Wye by their attorney
afd and whereupon the same William as before defends the force and Injury when &.^a and Saith
that he Cannot gainsay the action afd of the afd Day nor can he Say but that the Same William Wye
did assume upon himselfe in manner and form as the afd Day above against him hath Complained and
as to the damage of the Same Day by him by Occasion of the premisses in that part sustained the said
William saith and Confesseth that the afd Day Scott hath Sustained Damages by occasion of the
premisses
