159 and Injury when &.a and Saith that he Cannot Gainsay ^the action afd of^ the afd Thomas Nevett [illegible] says but that the sd Thomas Gray did assume upon himselfe in manner and form as the aforesaid Thomas Nevett above ^against him hath Complained^ and as to the damage of him the same Thomas Nevett by him by Occasion of the premisses in that part sustained the same Thomas Gray saith and Confesseth that the afd Thomas Nevett hath sustained damages ^by occasion of the premisses^ further than his Costs and Charges to Seven pounds five Shillings and two pence sterling and not more and because the aforesaid Thomas Nevet deny's not this but the same allegation Confesseth to be true prays Judgm.t for those damages above Confessed together with his Costs and Charges afd to him to be adjudged &a Therefore by Consent of the parties afd it is Considered that the afd Thomas Nevett Recover ag.t the said Thomas Gray his damages aforesaid to the afd Seven pounds five shillings and two pence 352 Sterling in form aforesaid Confessed as also three hundred and Seventy Four pounds of tobacco for his Costs and Charges aforesaid to the same Thomas Nevett by the Court here and Consent of the parties afd adjudged and the afd Thomas Gray in Mercy &a
that whereas a Certain John Selby the twenty third day of august which was in the year of our Lord God Seventeen hundred and thirty four at Somerset County af.d (the same John then and there negotiating and Commerce Using) according to the use and Custome of merchants from the time whereof the memory of man is not Contra^r^y in such Case used and approved did make his Certain first Bill of Exchange in writing baring date the same day and year and the same Bill of Exchange with his proper name and hand then and there did Sub^s^cribe and that Bill unto a Certain M.r Robert Crookshanks merchant in London (then and yet negotiating and Commerce Using to witt at London in somerset County af.d) did direct and by the same Bill of Exchange did Require the same Robert Crookshanks at thirty days after Sight of that his said first Bill of Exchange his second and third Bills of Exchange of the same Tenor and date not paid to pay unto the af.d Thomas Gray (the same Thomas Gray then and yet Negotiating and Commerce using) to witt at Somerset County af.d) or order the sum of fourteen pounds ten ten Shillings Sterling for value receved and charge the same to the Account of him the same John Selby and the af.d sum of money in the said first bill of Exchange mentioned) (in) |
