158 Exchange and non payment of the Contents thereof when he Should be afterwards thereunto requested unto the same Thomas Nevett well and faithfully would pay and Content and the afd Thomas Nevett in fact Saith that the Lawfull Costs damages and Interests of him the Same Thomas Nevett by the afd Occasion of the non acceptance and non payment of the Contents of the afd first Bill of Exchange amount unto the Sum of one pound three Shillings and Eleven pence Sterling whereof the said Thomas Gray the day year and place Last mentioned had notice Nevertheless the afd Thomas Gray his promise and assumption afd nothing regarding but minding and fraudulently Intending the said Thomas Gray Nevett in this part Craftilly and Subtilly to deceive and defraud the afd Six pounds one Shilling and three pence Sterling together with all Lawfull Costs damages and Interset afd which in the whole amount to the Sum of Seven pounds five shillings and two pence Sterling or any penny thereof to the afd Thomas Nevett hath not paid [altho' to do the same the afd Thomas Gray afterwards to witt the Same day and Year Last Mentioned and often afterwards at Somerset County afd by the afd Thomas Nevett he was required) but that unto him hitherto to pay altogether hath refused and Still doth refuse to the damage of the Same Thomas Nevett Fourteen pounds Sterling and ^one^ thousand pounds of tobo and thereof he brings suite &a pledges &a Jno Doe & Rd Roe Whereupon Came hereinto Court the said Thomas Gray in his proper person and thereupon the said Thomas Gray by the Court here at the prayer of the afd Thomas Nevett by hs attorney afd is adjudged to give Special bail to the action afd Whereupon Came hereinto Court a Certain John Finch Late of Somerset County planter and undertook for the afd Thomas Gray and assumed upon himselfe (Likewise the same Thomas Gray assumed upon himselfe) that if in Case the said Thomas Nevet should recover Judgment in the plea afd against the said Thomas Gray or that the Same Thomas Gray should be therein Convicted that then he the said Thomas Gray should pay the Judgment of the Court thereupon or Render his body to the prison of the Sheriff of Somerset County in Execution of Such Judgmt or that he the said John Finch will do the Same for him &a And the aforesaid Thomas Gray by Thomas Bluett his attorney Cometh and defendeth the force and Injury when &a and prays Leave to Imparle hereuntill next Court and he hath it and the Same day is Given to the afd Thomas Nevett here also &a Att which said next Court to witt the Eighteenth day of November anno Dom One thousand Seven hundred and thirty five Came againe as well the afd Thomas Nevett as the afd Thomas Gray by their attorneys afd and where^upon^ the afd Thomas Gray prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd Thomas Nevett here also &a Att which said next Court to witt the Sixteenth day of March anno Dom One thousand Seven hundred and thirty five Came again as well the afd Thomas Nevett the afd Thomas Gray by their attorneys afd and Whereupon the same Thos Gray by his said attorney as before defends the force and |
