159 in no Sort being paid the aforesaid Thomas Gray afterward to witt the day of in the year aforesaid at Somerset County aforesaid by an Indorsment with the proper name and ^bound of^ him the same Thomas Gray upon the Same first bill of Exchange subscribed according to the Use and Custome of Merchants af.d from all the time af.d used and approved did order the same sum of money in the same first bill of Exchange mentioned to be paid unto the af.d Thomas Nevett (the same Thomas then and there Negotiating and Commerce using) or order according to the tenor of the same Bill of Exchange for value received and afterwards to witt the Twenty fifth day of January ann Dom Seventeen hundred thirty and four at London af.d in Somerset County af.d the af.d first bill of Exchange as af.d indorsed unto the af.d Robert Crookshanks was shewn and the same Robert Crookshanks then and there was required to accept the said first bill of Exchange according to the use and Custom of Merchants from all the time af.d used and approved and make payment of the said fourteen pounds ten shillings Sterling unto the af.d Thomas Nevett according to the form and Effect of the Indorsment af.d of the same bill (the af.d Robert Crookshanks before that time there having thirty days sight of the said first bill of Exchange and the said second and third bills of Exchange of the same tenor and date or either of them then or yet not being Accepted or paid) but the same Robert Crookshanks the af.d first Bill of Exchange then or yet did not Accept but the same first Bill of Exchange then and there to Accept did refuse and and the af.d fourteen pounds ten Shillings Sterling in the said first bill of Exchange Specified unto the same Thomas Nevett according to the tenor of the Indorsment af.d on the same bill of Exchange hath not paid but that to do altogether did refuse by reason whereof the same first bill of Exchange then and there according to the use and Custom of merchants in that part from all the time af.d used and approved in due form in writing was protested for want of Acceptance of the same first bill of Exchange and payment of the said fourteen pounds ten Shillings strling in the same first bill of Exchange specified of all which premisses the same Thomas Nevett afterwards to wit the day of in the year of our Lord God Seventeen hundred thirty and five at Somerset County af.d unto the af.d John Selby and Thomas Gray did give Notice by pretext of which premisses the af.d Thomas Gray according to the use and Custom of Merchants from the whole time af.d as before used and approved became and was Chargeable to pay to the af.d Thomas Nevett the af.d fourteen pounds ten Shillings Sterling in the af.d first Bill of Exchange mentioned with all the lawfull damages Costs and Interest by the said Thomas Nevett suffered and Sustained for want of due acceptance of the said first bill of Exchange and by occasion of the Non payment of the Contents thereof to the said Thomas Nevett or order and thereupon the said Thomas Gray afterward to witt the same day and year last mentioned at the place af.d in Consideration of the premises upon himself did assume and to the same Thomas Nevett then and there faithfully did promise that he the af.d Thomas Gray the af.d fourteen pound ten Shillings Sterling with all lawfull Costs damage and Interest by the said Thomas Nevett suffered and sustained by Occasion of the non Acceptance of the af.d first Bill of Exchange and non payment of the Contents thereof when he should be afterwards thereunto required unto the same Thomas Nevett well (and) |
