158 Afterwards to witt the Twenty fifth day of January anno Dom Seventeen hundred and thirty four at London afd at Somerset County afd the afd first Bill of Exchange so as afd Indorsed unto the afd Charles Rogers was Shown and the Same Charles Rogers then and there was required to accept the said first bill of Exchange according to the use and Custome of Merch.ts from all the time afd used and approved and make payment of the said Six pound One Shilling & three pence Sterling unto the afd Thomas Nevett according to the form and Effect of the Indorsment afd of the same bill [the afd Charles Rogers before that time there being having thirty days Sight of the said first Bill of Exchange and the said Second and third Bills of Exchange of the Same Tenor & date or either of them then or yett not being accepted or paid) but the Same Charles Rogers the afd first Bill of Exchange then or yett did not accept but the Same first Bill of Exchange then and there to accept did refuse and the afd Six pound One Shilling and three pence Sterling in the said first bill of Exchange Specified unto the same Thomas Nevett according to the Tenor of the Indorsment afd on the Same Bill of Exchange hath not paid but that to do altogether did refuse by reason whereof the Same first Bill of Exchange then and there according to the Use and Custom of Merchants in that part from all the time afd used and approved in due form in writing was protested for want of acceptance of the Same first Bill of Exchange and payment of the Said Six pounds One Shilling and three pence Sterling in the same first bill of Exchange Specified of all which premisses the Same Thomas Nevett afterward to witt the day of in the year of Our Lord God Seventeen hundred thirty and five at Somerset County afd unto the afd James Scott and Thomas Gray did give Notice by pretext of which premisses the afd Thomas Gray according to the Use and Custom of Merchants from the whole time afd as before used and approved became and now was Chargable to pay to the afd Thomas Nevett the afd Six pound One Shilling and three pence Sterling in the afd first Bill of Exchange mentioned with all the Lawfull damages Costs ^&^ Interest by the said Thomas Nevett Suffered and Sustained for want of due acceptance of the said first bill of Exchange and by Occasion of the non payment of the Contents thereof to the said Thomas Nevett or order and thereupon the said Thomas Gray afterwards to witt the Same day and Year Last mentioned at the place afd in Consideration of the premisses upon himselfe did assume and to the Same Thomas Nevett then and there faithfully did promise that he the afd Thomas Gray the afd Six pounds one Shilling and three pence Sterling with all Lawfull Costs damages ^&^ Interest by the said Tho.s Nevett suffered and Sustained by occasion of the Non acceptance of the afd first bill of Exchange |
