157 Wallace and assumed upon himselfe (Likewise the Said Richard Wallace assumed upon himselfe) that if in case the said John Reddish should recover Judgm.t in the plea afd against the said Richd Wallace or that the Said Richard Wallace should be therein Convicted that then he the said Richard Wallace shall pay the Judgment of the Court thereupon or render his body to the prison of the Sheriff of Somerset County in Execution of Such Judgment or that he the said Lewis Jones will do the same for him &a And whereupon the Same Richard Wallace by Francis Allen his attorney Cometh and defendeth the force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd John here also &a Att which said next Court to witt the seventeenth day of June anno Dom One thousand Seven hundred and thirty five Came again as well the Same John Reddish as the afd Richard Wallace by their attorneys afd and whereupon the same Richard Wallace prays further Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd John here also &a Att Which said next Court to witt the ninteenth day of August Anno Dom One thousand Seven hundred and thirty five Came again as well the afd John Reddish as the afd Richard Wallace by their attorneys afd and whereupon the same Richard Wallace prays further Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd John here also &a Att which said next Court to witt the Eighteenth day of november Anno Dom one thousand seven hundred and thirty five Came againe as well the afd John Reddish as the afd Richard Wallace by their attorneys afd and Whereupon the said Richard prays further Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd John here also &.a Att which said next Court to witt the Sixteenth day of march anno Dom One thousand Seven hundred and thirty five Came againe as well the afd John Reddish as the afd Richard Wallace by their attorneys afd and whereupon the said Richard as before defends the force and Injury when &.a and saith that he did not assume upon himselfe in manner and form as the said John above against him hath Complained and of this he putts himselfe upon the Country &.a and the afd plft Likewise whereupon the afd Richard Wallace Relinquisheth his Verification aforesaid by him above alledged and says that he Cannot gainsay the action afd of the afd John Reddish nor Can he say but that he did assume upon himselfe in manner and form as the afd John above against him hath Complained and as to the damage of ^him^ the same John Reddish by him by Occasion of the premisses in that part Sustained the same Richard saith and Confesseth that the afd John hath sustained damages by occasion of the premisses afd further than his Costs and Charges by him |
