156 Dias did not prosecute with Effect but voluntarily permitted his Suit to be discontinued Therefore afterwards to witt the that same day by discretion of the Justices here were adjudged to the same Robert Dias pounds of tobacco for his Costs and 156 Charges by him about his defence in that part Sustained according to the form of the Statute in such Case there^of^ lately made and provided and the afd Joseph in Mercy and that the afd Robert have thereof Execution &a
thirty four at Somerset County was Indebted unto the same John in the sum of three pound^s^ four shilings and seven pence Current money being for thirty one Bushells of Indian Corn by the af.d John to the af.d Richard at his especial Instance and Request there before that time sold and delivered as by an Account thereof herewith into Court brought may appear and so thereof being Indebted the same Richard in Consideration thereof afterwards to wit the same day and year af.d at the County af.d upon himself did assume and to the same John then and there faithfully ^did^ promise that he same Richard the same three pounds four shillings and seven pence to the same John when thereof afterwards he should be required well and faithfully would pay and Content Nevertheless the af.d Richard his promise and assumption af.d nothing regarding but minding and fraudulently Intending the same John in this part Craftily and subtily to deceive and defraud the af.d three punds four shillings and seven pence or any part thereof to the same John (altho to do the same same by the same John John the same Richard afterward to wit the first Day of November in the year af.d at the County af.d and often afterwards there was required hath not paid or him for the same in any sort contented but that unto him to pay or for the same in any sort to content hitherto to altogether hath refused and still doth refused to the Damage of the same John six pounds ten shillings and thereof he brings suit &.a pledges &a Jno Doe & R Roe 1734 aprill 18.th Richard Wallace Carpenter Dr To 31 Bushells of Corn @ 2/1 p Bushell £3..4..7 Errors Excepted p John Reddish March the 12.th 1734/5 Came John Reddish before me the Subscriber and made Oath in due form that the above acco.t is Just and True and that he hath Rec.d no part or parcell thereof or anything in Satisfaction John Handy Whereupon Came hereinto Court the said Richard Wallace in his proper person and thereupon the said Richard Wallace by the Court here at the prayer of the afd John Reddish by his attorney afd is adjudged to give Speciall Bail to the action afd Whereupon a Certain Lewis Jones Late of Somerset County planter present herein Court in his proper person undertook for the said Richard Wallace |
