And whereupon the same Edmond by Robert Jenckins Henry his attorney saith that whereas the af.d James the Second day of Aprill in the Year of our Lord one thousand seven hundred thirty and four at Somerset County af.d within the Ju.r of this court by his certain writing obligatory did acknowledge himself to be held and firmly bound unto the aforesaid Edmond in the af.d Seven hundred pounds of tobbacco to be paid to the same Edmond when he should thereuto requested Nevertheless the said James altho often thereunto Requested the af.d seven hundred pounds of tobacco to the same Edmond he hath not as yet Rendered but the same to him hitherto to render hath denied and Still doth refuse and deny Wherefore he saith that he is the worse and hath damage to the value of seven hundred pounds of tobbacco And thereof he brings suit &.c and brings here into Court the writing aforesaid which the debt af.d in form af.d doth testify the date whereof is the same day and year af.d pledges &.a John Doe & R Roe And the aforesaid James Smith by George Douglas his attorney Comes and defends the force and Injury when &.a and saith that he Cannot gainsay the action afd of the afd Edmond Jennings nor Can he say but that the writing Obligatory afd is the deed of the Same James Smith nor Can he say but that he owes the Same Edmond Jennings the afd Seven hundred pounds of tobacco in manner and form as the afd Edmond above against him hath declared wherefore the same Edmond prays Judgmt for his debt afd and his damages Sustained by Occasion of the detaing of the Same debt to him to be adjudged &a Therefore it is Considered by the Court here that the afd Edmond Jennings Esqr Recover against the afd James Smith his debt afd and his damages by occasion of the detaining of that Same debt to One hundred & Ninty Six pounds of tobacco to the Same Edmond of his assent by the Court here adjudged and the afd James in Mercy &a
