the said Thomas Mitchell prays Judgment for his debt afd and his damages Sustained by occasion
of the detaining of the Same debt &a

          Therefore it is Considered by the Court here that the afd Thomas Mitchell recover against
the afd John Bishop his debt afd and his damages Sustained by Occasion of the detention of that

Otherwise Called Mathew Hosey of Somerset County was somoned
to answer unto Edmond Jennings Esq.r of a plea that he render unto
him Seven hundred pounds of tobacco which to him he owes and unjustly detaines &a

And whereupon the same Edmund by Robert Jenckins Henry his attorney
saith that whereas the af.d mathew the twenty Second day of february in the year of
our Lord one thousand Seven hundred thirty and three at Somerset County af.d within
the Jur of this Court by his certain writing obligatory did acknowledge himself
to be held and firmly bound to the same Edmund in the af.d seven hundred pounds of
tobacco to be paid to the same Edmund Jennings when he should be thereunto requested

Nevertheless the said mathew altho' often thereunto Requested the af.d seven hundred
pounds of Tobacco to the same Edmund he hath not as yet Rendered but the same to him
hitherto to render hath denied and still doth refuse and deny  Wherefore he saith he is
the worse and hath damage to the value of one thousand pounds of Tobacco  And thereof
he brings suit &.a and brings hereinto Court the writing af.d which the debt af.d in form
af.d doth testify the date whereof is the same day and year af.d
                                                                                     pledges &a  Jno Doe & R Roe

       Whereupon the said Mathew Hosey by George Douglas his attorney Cometh and defendeth the
force and Injury when &a and saith that he Cannot Gainsay the action afd of the afd Edmond Jennings nor
can he say but that the writing Obligatory aforesaid is the deed of the Same Mathew nor Can he Say
but that he Owes the Same Edmond the afd Seven hundred pounds of tobacco in manner and form
as the afd Edmond above against him hath declared wherefore the Same Edmond prays Judgmt for his
debt ads and for his damages Sustained sustained by Occasion of the detaining of the Same Debt to him to
be adjudged &a
                                                Therefore it is Considered by the Court here that the afd Edmond Jennings
Esq.r Recover against the afd Mathew Hosey his debt afd and his damages by Occasion of the
474   detention of that Same debt to One hundred & Ninty Six                           pounds of tobo
to the Same Edmond of his assent by the Court here adjudged &a and the afd deft in Mercy &a
