152 Peter Frazer in his proper person Cometh and defendeth the force and Injury when &a and saith that he cannot gainsay the action afd of the afd Jacob Cullen nor Can he say but that he did assume upon himselfe in manner and form as the afd Jacob Cullen above against him hat Complained and as to the damage of him the same Jacob Cullen by him by Occasion of the premises in that part sustained the same Peter saith and Confesseth that the afd Jacob Cullen hath Sustained damages by occasion of the premisses further than his Costs and Charges by him about his Suit in that part apposed to two Barrells of good merchantable Pork and two shillings & Six pence Curr.t money and not more and because the aforesaid Jacob denys not this but the Same allegation Confesseth to be true prays Judgm.t for those damages afd above Confessed together with his Costs and charges afd to him to be adjudged &a Therefore by Consent of the parties aforesaid it is Considered by the Court here that the afd Jacob Cullen recover against the aforesaid Peter Frazer his damages afd to the afd Two Barrells of good merchantable Pork and two shillings and Six pence Currt money in form afd Confessed as also 304 pounds of tobacco for his Costs and Charges aforesaid to the Same Jacob Cullen by the Court here and Consent of the parties afd adjudged and the afd deft in mercy &a
then next to answer unto John Dennis Jun.r of a plea of trespass upon the Case &a and that thereof he should not fail &a And the Said John Dennis Jun.r by Francis allen his attorney Complained against the John Donelson in the plea afd as followeth viz.t Somerset sst John Donelson Late of Somerset County Marriner was attached to answer unto John Dennis Jun.r of a plea of trespass upon the Case &a And whereupon the same John Dennis Jun.r by Francis Allen his attorney Complaines that whereas the said John Donelson on the Twenty fourth day of March Anno Dom Seventeen hundred Thirty and Three at Somerset County within the Jur of this Court was Indebted to the said John Dennis in the sum of Nine pounds Current money of Maryland to be paid in Gold and the Quantity of Nine thousand one hundred and Eleven and an half pounds of Tobbacco for Sundry matters and things prop^e^rly Chargeable in an Account as by an Account thereof hereunto Annexd and here into Court brought may appear and so therreof being Indebted the said John Donelson in Consideration thereof upon himself did assume and to the said John Dennis then and there faithfully did promise that he the said John Donelson the said Sum of (Nine) |
