County aforesaid within the Jurisdiction afd upon himselfe did assume and to the same Jacob
then and there faithfully did promise that he the afd Peter the afd two Barrells of good
merchantable pork and two shillings and Six pence in money upon demand to the same
Jacob he would well and faithfully pay and Content  Nevertheless the afd Peter his promise
and Assumption af.d in form afd made nothing regarding but minding and fraudulently
intending the af.d Jacob in that part Craftily and Subtilly to deceave and Defraud
the af.d Two Barrells of pork and two shillings and six pence or any part thereof
the same Peter to the said Jacob hath not as yet paid or caused to be paid on or
the same in any sort Conte^n^ted or Satisfied altho' the same to do the af.d peter afterwards
(to witt) the same day and year af.d at Somerset County af.d and often afterward by the
same Jacob was thereunto requested but the same hitherto to pay or for the same
in any sort to Content the same Peter hath altogether refused and still doth
refuse and deny  Whereupon the said Jacob saith that he is worse and hath
Damage to the value of seven pounds Current Money of Maryland and thereupon
he brings suit &a                                       pledges &a  Jno Doe & R Roe

A Copy of the foregoing declaration was made and sent to be Served on the deft
with the writt in the plea aforesaid according to act of assembly in Such Case made & provided

    Att which said third Tuesday of march to witt the sixteenth day of the Same month
Anno Dom One thousand Seven hundred and thirty five being the day of the return of
the same writt Cometh the said Jacob Cullen by his attorney afd and the Sheriff of Somerset
County to whom the foregoing writt was directed  Likewise Cometh and maketh return thereof
to the Court there thereof Endorsed in these words Following vizt Cepi Corpus declaration
delivered in time    P Joseph MccClester sher

       Whereupon Came hereinto Court the said Peter Frazer in his proper person and thereupon
the said Peter Frazer at the prayer of the afd Jacob Cullen by his attorney afd is adjudged
by the Court here to give Speciall Bail to the action afd  whereupon a Certain David Wilson
of Somerset County Gent present herein Court undertook for the same Peter Frazer and
Assumed upon himselfe [Likewise the said Peter Frazer assumed upon himselfe) that if
in Case the said Jacob Cullen should recover Judgment in the plea ^afd^ against the said Peter
Frazer or that the said Peter Frazer should be therein Convicted that then he the said
Peter Frazer should pay the Judgment of the Court thereupon or render his body in Execution
of Such Judgm.t to the prison of the Sheriff of Somerset County in Satisfaction thereof or that
he the said David Wilson will do the Same for him &.a         And whereupon the said
