151 Such Judgment to the prison of the Sheriff of Somerset County in Satisfaction thereof or that he the said John Gornwell will do the Same for him &a Whereupon the said William Stevens in his proper person Cometh & defendeth the force and Injury when &a and saith that he Cannot gainsay the action afd of the afd Jacob Hamond nor can he say but that the writing Obligatory afd is his deed nor but that he Owes the Same Jacob the afd Seven pounds Curr.t money in manner and form as the afd Jacob above against him hath declared wherefore the same Jacob prays Judgmt for his debt afd and his damages Sustained by Occasion of the detention of the Same debt to him to be adjudged &a Therefore it is Considered by the Court here that the afd Jacob Hamond recover against the aforesaid William Stevens his debt afd and his damages Sustained by Occasion of the detention of that same debt 329 to pounds of tobacco by the Court here unto the same Jacob Hamond of his assent adjudged and the aforesaid William ^in^ Mercy &a
Somerset to be held at dividing Creek the third tuesday of March then next to answer unto Jacob Cullen of a plea of trespass upon the Case &a and that thereof he Should not fail &a And the said Jacob Cullen by Robert Jenckins Henry his attorney Complained against the said Peter Frazer in the plea afd as followeth vizt Somerset ss.t Peter Frazer Late of Somerset County planter was attached to answer unto Jacob Cullen of a plea of trespass upon the Case &a And whereupon the same Jacob by Robert Jenckins Henry his attorney Complaineth that whereas the af.d peter after the first day of may Anno Dom seventeen hundred and five (to witt) the ninth day of February in the year of our Lord one thousand seven hundred thirty five and six at Somerset County af.d (within the Jur of this Court) made his certain Note in writing comonly called a promisso^r^y note with his proper hand thereunto subscribed bearing date the same day and year last above mentioned which said note the af.d peter to the same Jacob then and there did Deliver and by the same note he did oblidge himself to pay or Cause to be paid to the af.d Jacob by the name of Jacob Cullin the sum or Quantity of two Barells of good merchantable pork upon demand and Two shillings and six pence in money for value receiv'd (as by the said Note hereinto Court brought may appear) by reason of which said promise and also by force of the Statute in such case thereof made and provided the same peter became Chargeable o pay to the same Jacob the af.d Two Barrells of good Merchantable pork and Two Shilings and Six pence in money upon demand according to the Tenor of the same note and the af.d peter so thereof being Cargeable in Consideration thereof afterward (to witt) the same day and year last above mentioned at Somerset (County) |
