151 pounds Curr.t money of the afd province which to him he Owes and unjustly detaines &a and that thereof he should not fail &.a And the afd Jacob Hamond by Francis Allen his attorney Complained against the aforesaid William Stevens in the plea afd as followeth vizt Somerset County ss.t William Stevens late of allhollows parish in the county of Somerset planter al.s dict Will.m Stvens of of Somerset County In the province of Maryland planter was sumoned to answer unto Jacob Hammond of a plea that he Render unto him Seven pounds Current money of the aforesaid province which to him he Owes and Unjustly detaines &a And whereupon the said Jacob by Francis Allen his attorney saith that whereas the said william the twenty third day of September anno Dom seventeen hundred and thirty five at the County of Somerset af.d within the Jur of this Court by his certain writing obligatory which the said Jacob with the seal of the said william signed here into Cort brings the date whereof ^as^ the same day and year did acknowledge himself to owe and stand Justly indebted unto the af.d Jacob in the af.d seven pounds money af.d to be paid as followeth in Corn wheat porke or Tobacco at the markett price at or before the first day of February next Ensuing the day of the date of the said writing yett the said william tho' often required the said seven pounds money af.d according to the Content of the said writing unto the said Jacob upon the af.d first day of February hath not rendred but the same to him hitherto to render hath denyed and still doth deny and unjustly detain Whereupon the said Jacob saith he is worse and hath damage to the value of six pounds Curr.t money of Maryland af.d And thereupon he brings suite &a pledges &a Jno Doe R Roe A Copy of the foregoing declaration was made and Sent to be Served on the deft according to act of assembly in such Case made and provided &a Att which said third Tuesday of March to witt the Sixteenth ^day^ of the same month anno Dom One thousand seven hundred and thirty five being the day of the return of the Same writt Cometh the said Jacob Hamond by his attorney aforesaid and the Sheriff of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following viz.t Cepi Corpus declaration delivered in time p Jos MccClester sher Whereupon the said WIlliam Stephens Came hereinto Court in his proper person and thereupon the Said William Stevens at the prayer of the afd Jacob Hamond is adjudged ^by the Court here^ to give Special Bail to the action afd Whereupon a Certain John Gornewell Late of Somerset County planter present here in Court in his proper person undertook for the Same William Stevens and assumed upon himselfe [Likewise the Said William Stevens assumed upon himselfe) that if in Case the said Jacob Hamond should recover Judgment in the plea afd against the said William Stevens or that the said William Stevens should be therein Convicted that then he the said William Stevens should pay the Judgment of the Court thereupon or render his body in Execution of such |
