150 in form aforesaid doth testifie dated the Same day and Year aforesaid &.a pledges Jno Doe R Roe A Copy of the foregoing declaration was made and Sent to be served on the defend.t according to act of assembly in Such Case made and provided &a Att which said third Tuesday of march to witt the Sixteenth day of the same month ann Dom One thousand Seven hundred and thirty five being the day of the return of the said writt Came the Said Robert King Henry Ballard and John Henry by their attorney afd and the Sheriff of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following vizt Cepi Corpus declaration delivered in time p Joseph MccClester sher Whereupon the said Stephen Horsey Administrator as afd by George Douglas his attorney Cometh and defendeth the force and Injury when &.a and thereupon the said Robert King Henry Ballard and John Henry pray that the afd Stephen to their declaration afd may answer and upon this the afd Stephen hath untill Fryday ten a Clock being the fourth day of this term to him by the Court here given to answer unto the declaration afd of the afd Robert King Henry Ballard and John Henry and the same attorney of the said Stephen at the same day says that he is not Informed by the same Stephen his Clyant of any answer for the Same Stephen to the afd Robert Henry and John in the plea afd to be given and nothing Els thereof says by which the Same Rob.t Henry and John remain against the afd Stephen thereof undefended &a Therefore it is Considered by the Court here that the afd Robert King Henry Ballard and John Henry Recover against the afd Stephen Horsey administrator of the afd Burr Outerbridge their debt afd and their damages Sustained by Occasion of the detention of that Same debt to 368 pounds of tobacco to the Same Robert Henry and 388 John of their assent by the Court here adjudged ^to be levied^ of the goods and Chattells which were of the said Burr Outerbridge at the time of his death in the hands of the afd Stephen to be administred on if so much thereof in his hands to be administred on he hath and if he have not than the damages afd to be Levied of the proper goods and Chattells of the Same Stephen & the afd deft in Mercy &a
his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of march then next to answer unto Jacob Hamond of a plea that he Render unto him Seven pounds |
