and him should safe keep so that he might have his body before before the Justices of his Lordships
County Court of Somerset to be held at dividing Creek the third Tuesday of March then
next to answer unto Robert King Henry Ballard and John Henry of Somerset County
Gent of a plea that he Render unto them forty pounds Curr.t Cash of America which from
them he unjustly detaineth &a and that thereof he Should not fail &a

       And the afd Robert King Henry Ballard and John Henry by Robert Jenckins
Henry their attorney declared against the afd Stephen Horsey in the plea afd as followeth
vizt      Somerset ss Stephen Horsey late of Somerset County Gent administrator of all and
Singular the goods and Chattells Rights and Creditts of Burr Outerbridge dec.d at the time of his
death who died Intestate as it is said Otherwise Lately Called Burr Outerbridge of
Somerset County marriner was sumoned to answer unto Robert King Henry Ballard and
John Henry of Somerset County Gent of a plea that he render unto them Forty pounds Curr.t
money cash of America which from them he unjustly detaineth &a

And whereupon the same Robert King Henry Ballard and
John Henry by Robert Jenckins Henry their attorney says that
whereas the af.d Burr in his Life time (to witt) the twenty Ninth day
of Aprill in the year of our Lord one thousand seven hundred thirty
and two at Somerset County (within the Jur of this Court) by his certaine
writing obligatory did Acknowledge himself to be held and firmly bound
unto the said Robert King Henry Ballard and John Henry in the
af.d Forty pounds Curr.t Cash of America to be paid to the said King Ballard
and Henry when thereunto he should be afterwards requested nevertheless
the afd Burr in his Lifetime and the af.d Stephen after the death of
the said Burr (to whom Administracon of all and singular the goods and
Chattells Rights and Credits whih were of the af.d Burr at the time of his
death by Nehemiah King Gen.t Deputy Comissary of Somerset County
of Somerset County in due for use of law was Commited) altho' often thereunto
Requested the af.d forty pounds to the said King Ballard & Henry or
Either of them have not rendered nor either of them hath rendred but
the the same to them to render the said Burr in his Lifte time and the
af.d Stephen since the death of the said Burr hath denyed and the same
to them the said Stephen still refuseth to render and unjustly Detains
Wherefore they say that they are the worse and have Damage
to the value of Forty pounds Curr.t money af.d and there of they bring
suit &c   And bring here into Court the writing af.d to which the debt af.d
