147 Porter and made Oath on the holy Evangelist of almighty God that the above acco.t is Just and true and that he hath not received part nor parcell thereof sworn before me this 7 day of march 1735/6 Ed: Rownd And whereupon the Said John Bell in his proper person cometh and defendeth the force and Injury when &a and saith that he Cannot gainsay the action aforesaid of the aforesaid Francis Porter nor can he say but that he did assume upon himselfe in manner and form as the aforesaid Francis Porter above against him hath Complained and as to the damage of the Same Francis Porter by him by Occasion of the premisses in that part Sustained the Same John Bell saith & Confesseth that the afd Francis Porter hath Sustained damages by Occasion of the premisses further than his Costs and Charges by him about his Suit in that part apposed to three pounds tenn Shillings Curr.t money of maryland and not more and because the same Francis Porter denys not this but the Same allegation Confesseth to be true prays Judgm.t for those damages above Confessed together with his Costs and Charges afd to him to be adjudged &a Therefore by Consent of the parties afd it is Considered by the Court here that the afd Francis Porter recover against the aforesaid John Bell his damages aforesaid to the aforesaid three pounds tenn Shillings Curr.t money of Maryland in form afd Confessed as also Two hundred & thirty 212 four pounds of tobacco for his Cost and Charges afd to the Same Francis Porter by the Court here and Consent of the parties afd adjudged and the afd defend.t in mercy &a
his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of Mar then next to answer unto Isaiah Bredall of a plea that he Render unto him ninteen pounds & tenn pence Curr.t money of Maryland which to him he owes and Unjustly detaines &a and that thereof he Should not fail &a And the said Isaiah Bredall by Francis Allen his attorney declared against the said Joseph Hall in the plea afd as Followeth vizt Somerset County ss Joseph Hall Late of Somerset County planter al.s dict Joseph Hall of Somerset County in the province of maryland planter was Somoned to answer unto Isaiah Bredall of a plea that he render unto nineteen pounds and tenn pence Curr.t money of Maryland which to him he owes & unjustly detaines &a And whereupon the said Isaiah by Francis Allen his attorney saith that whereas the said Joseph the seventeenth day of February seventeen hundred and thirty four five at Somersett County af.d within the Jurr of this Court by his certain writing obligatory which the said Isaiah with the seal of the said Joseph signed here into Court brings the date whereof is the same day and (year) |
