147 George Sparkman then and there his writt aforesaid against the afd Henry Reynolds did not prosecute with Effect but Voluntarily permitted his Suit to be discontinued Therefore afterwards to witt the same day and year abovesaid by discretion of the Justices of his Lordships County Court of Somerset here were adjudged to the Same Henry 153 Reynolds One hundred and Seventy Five pounds of tobacco for his Costs & Charges by him about his defence in that part Sustained according to the form of the Statute in Such manner of Case thereof Lately made and provided and the afd George in Mercy and that the afd Henry have thereof execution &a
day of June Anno Dom one thousand seven hundred thirty and four at Somerset County within the Jurisdiction of this Court was Indebted unto the said francis in the sum of three pounds and Ten Shillings Current money of Maryland it being Cash lent as by Acct herewith into Court brought may Appear and so there of being Indebted the said John in Consideration thereof afterwards (to witt) the same day and year aforesaid at the place af.d at the place aforesaid upon himself did assume and to the said francis then and there faithfully did promise that he the said John the said sum of Three pound and tenn shillings when afterwards he should be thereunto requested he would well and faithfully pay and Content Nevertheless the said John his promise and assumpcon aforesaid in form aforesaid in form af.d made little regarding but Plotting and fraudulently Intending the same Francis in that part Craftily and Subtilly to deceive and defraud the af.d sum of three pounds and Ten Shillings Curr.t mony af.d nor any part thereof to the same Francis hath paid or him for the same any way Contented altho' the said John afterwards (to witt) the same day and year aforesaid at the County af.d ^within the Jurisdiction af.d^ by him the said Francis was thereunto requested but the said John the same to pay or in any sort Content and satisfie hetherto althogather hath refused and still doth refuse whereby the same Francis sayeth he is the worse and hath damage to the value of seven pounds Currant money of the province af.d and thereupon he brings suit &a pledges &a Jno Doe & Richd Roe
