afd in the County aforesaid within the Jurisdiction of this Court One pair of Boots of the Value of One hundred pounds of tobacco of the goods and Chattells of John Reed Jun.r then and there being found then and there feloniously did Steale take and Bear away Contrary to the peace of the Said Lord proprietary that now is his good rule and Government and against the form of the act of assembly in such Case Lately made and provided &a Test Mitchell Dashiell, John Reed Jun.r Obadiah Reed Samuel Fluellin On the backside of the foregoing bill of Indictment it was thus Endorsed Billa Vera Edm Hough foreman Thereupon Command was given to the Sheriff of Somerset County that he Should take the said Jeremiah Lilley if &a to answer &a and afterwards to witt the Sixteenth day of March anno Dom one thousand Seven hundred and thirty five before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in and for the Same County Came the Said Jeremiah Lilley in his proper person under Custody of the Sheriff of Somerset and being by the Same Sheriff Led to the Barr had a hearing of the Indictment afd and being Instantly demanded how he would acquitt himselfe of the felony afd as by the Indictment afd above upon him supposed says that of the felony afd above against him supposed he is guilty thereof and Every thing in the Indictment afd Expressly Confesseth &a whereupon all and Singular the premisses by the Court here Seen heard & fully understood thereupon the Court here according to act of assembly in Such Case made and provided valued the boots afd mentioned to Sixty pounds of tobacco Wherefore it is Considered by the Justices here that the afd Jeremiah Lilley pay unto the afd John Read Jun.r the party deprived four fold of the value of the boots afd Stolen which amounts in the whole to two hundred and forty pounds of tobacco and that the said Jeremiah Lilley be whipt with tenn Stripes at the publick whiping post on the bare back well Laid on untill the blood appear and that he Stand Immediately in the pillowry one quarter of an hour and that he be taken &a and thereupon as to the Corporall punishment afd Command is given to the Sheriff of Somerset County that he doe thereof Immediate Execution by whiping of the said Jeremiah Lilley at the publick whiping post with tenn Stripes ^on the bare Back^ well Laid on untill the blood appear and by Setting him in the pillowry Immediately one quarter of an |
