1735 139 Jeremiah Lilley Command is given to the Sher of Somerset County that he doe the Same Immediately &a
of this Court One pair of Stockins of the Value of thirty pounds of tobacco of the goods and Chattells of McKenny Porter then and there being found then and there feloniously did Steal take and bear away Contrary to the peace of the Said ^Lord^ Proprietary that now is his good rule & Government and against the form of the act of assembly in such Case made and provided &a Test Joseph McClester Fran Porter Joshua Merrill and McKemmy Porter On the backside of the foregoing Bill of Indictment it was thus Endorsed vizt Billa vera Edm Hough foreman Thereupon Command was given to the Sheriff of Somerset of Somerset County that he Should take the said Jeremiah Lilley if &a to answer &a and afterwards to witt the Sixteenth day of march anno Dom one thousand Seven hundred and thirty five before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in and for the Same County Came the said Jeremiah Lilley in his proper person under Custody of the Sheriff of Somerset County and being by the said Sheriff Led to the barr had a hearing of the Indictment afd and being Instantly demanded how he would acquitt himselfe of the felony afd as by the Indictment aforesaid above against him Supposed says that of the felony afd above against him Supposed he is guilty thereof and Every thing in the Indictment afd Expressly Confesseth &a Whereupon all and Singular the premisses by the Court here Seen heard and fully understood thereupon the Court here according to act of assembly in Such Case made and provided ^valued^ the pair of Stockins in the Indictment afd Stolen to thirty pounds of tobacco Wherefore it is Considered by the Justices here that the afd Jeremiah Lilley pay unto McKemmey Porter the party deprived four fold of the Value of the Stockins afd Stolen amounting in the whole to one hundred and Twenty pounds of tobacco and that the said Jeremiah Lilley be whipt at the publick whiping post with fifteen Stripes on the Bare back well Laid on untill the blood appear and that he stand Immediately in the pillowry one quarter of an hour and that he be taken &a and thereupon as to the Corporall punishment afd Command is given to the Sheriff of Somerset County that he do thereof Immediate Execution according to the Judgment afd Rendered by whiping of the afd Jeremiah Lilley at the publick whiping post with fifteen Stripes on the bare back well Laid on untill the blood appear and by Sitting him in the pillowry Immediately One quarter of an hour and afterwards in the Same Court Came the said Sheriff and made return that he had done the Execution of the Judgment afd as to the Corporall punishment afd he was Commanded &a whereupon it is Considered and ordered by the Court here that the afd Jeremiah Lilley be sold for any time not Exceeding Seven Years to the biggest bidder towards Satisfying of the four fold afd and the Severall officers their fees due by occasion of the premisses aforesaid and as to the Sale of the Said Jeremiah Lilley Command is Given to the Sheriff of Somerset County that he do thereof the Same Immediately &a |
