139 Lilley Command is given to the Sheriff of Somerset County that he do the Same Immediately &a
within the Jurisdiction of this Court two Jacketts of the Value of fifty pounds of tobacco each of the goods and Chattells of Obadiah Reed then and there being found then and there feloniously did Steal take and bear away contrary to the peace of the said Lord proprietary that now is his good rule & Government and against the form of the act of assembly in such Case Lately made and provided &a Test Capt Jno Handy, Mitchell Dashiell, John Reed Jun.r Obadiah Reed, Samuel Fluellin On the backside of the foregoeing bill of Indictment it was thus Endorsed vizt Billa vera Edm Hough Foreman Thereupon Command was given to the Sheriff of Somerset County that he should take the said Jeremiah Lilley if &a to answer &a and afterwards to witt the Sixteenth day of march anno Dom one thousand seven hundred and thirty five before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in and for the Same County Came the said Jeremiah Lilley in his proper person under Custody of the sheriff of Somerset County and being by the said sheriff Led to the to the Barr had a hearing of the Indictmt afd and being Instantly demanded how he would acquitt himselfe of the Felony afd as by the Indictment aforesaid above against him is Supposed who hereupon says that of the felony afd above against him Supposed he is guilty thereof and every thing in the Indictment afd Expressly Confesseth &a Whereupon all and Singular the premisses by the Court here Seen heard and fully understood thereupon the Court here according to act of assembly in Such Case made and provided valued the goods afd Stolen to witt two Jacketts in the Indictment afd mentioned to fifty pounds of tobacco &a Wherefore it is Considered by the Justices here that the afd Jeremiah Lilley pay unto Obadiah Reed the party deprived four fold of the value of the Jacketts aforesaid stolen amounting in the whole to two hundred pounds of tobacco and that the said Jeremiah Lilley be whipt at the public whiping post with tenn Stripes on the bare Back well Laid on untill the blood appear and that he stand ^Immediately^ in the pillowry one quarter of an hour and that he be taken &a and thereupon as to the Corporall punishment afd Command is Given to the Sheriff of Somerset County that he do thereof Immediate Execution according to the Judgment afd Rendered by whiping of the afd Jeremiah Lilley at the publick whiping post with tenn Stripes on the bare back well Laid on untill the blood appear and by Setting him in the pillowry Immediately one quarter of an hour and afterwards in the Same Court Came the said Sher and returned that he had done the Execution of the Judgmt afd as to the Corporall punishmt aforesaid he was Commanded &a Whereupon it is Considered and ordered by the Court here that the afd Jeremiah Lilley be sold for any time not Exceeding Seven Years to the Biggest bidder toward Satisfying of the fourfold afd and the severall officers their fees due by occasion of the premisses afd and as to the sale of the said Jeremiah |
