County afd within the Jurisdiction of this Court One pair of Shoes of the Value of thirty pounds of tobacco one white Linnen Shirt of the Value of Sixty pounds of tobacco and one perriwigg of the Value of two hundred pounds of tobacco of the goods and Chattells of Francis Porter then and there being found then and there feloniously did steal take and bear away Contrary to the peace of the said Lord Proprietary that now is his good rule and Government and against the form of the act of assembly in Such Case Lately made and provided &a Test Joseph MccClester Francis Porter Joshua Merrill On the backside of the foregoing Bill of Indictment it was thus Endorsed vizt Billa vera Edm Hough Foreman Thereupon Command was Given to the Sheriff of Somerset County that he should take the said Jeremiah Lilley if &a to answer &a and afterwards to witt the Sixteenth day of March Anno Dom One thousand Seven hundred and thirty five before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in and for the same County Came the same Jeremiah Lilley in his proper person under Custody of the Sheriff of Somerset County and being by the said Sheriff ledd to the Barr and had a hearing of the Indictment aforesaid above against him Supposed prays that of the felony afd above against him supposed he is guilty thereof and every thing in the Indictment aforesaid expressly Confesseth &a Whereupon all and Singular the premisses by the Court here seen heard and fully understood Valued the Shoes white Linnen Shirt and Perriwigg afd Stolen according to act of assembly in Such Case made and provided to two hundred and ninty pounds of tobacco Thereupon it is Considered by the Court here that the afd Jeremiah Lilley pay unto the afd Francis Porter the party deprived four fold of the value of the goods aforesaid stolen amounting in the whole to One thousand One hundred and Sixty pds of tobacco and that the said Jeremiah Lilley be whipt at the publick whiping post with twenty Stripes on the bare Back well Laid on untill the blood appear and that he stand in the pillowry One quarter of an hour and that he be taken &a and thereupon as to the Corporall punishment afd Command is given to the Sheriff of Somerset County that he do thereof Immediate Execution according to the Judgment afd Rendred by whiping of the afd Jeremiah Lilley at the publick whiping post with twenty Stripes on the bare back well Laid on untill the blood appear and by Sitting him in the Pillowry One quarter of an hour and afterwards in the Same Court Came the Said Sheriff and made return that he had done the Execution of the Judgmt afd as to the Corporall punishment afd he was Commanded &a Wherefore it is Considered & ordered by the Court here that ye said Jeremiah Lilley be sold for any time not Exceeding Seven Years to the biggest bidder towards Satisfaction of the four fold afd & the Severall officers Fees due by occasion of the premisses afd and as to the sale of the said Jeremiah Lilley |
