1735 137 Jeremiah Lilley in his proper person under custody of the Sheriff of Somerset County and being by the said Sheriff Led to the barr and had a hearing of the Indictment afd and being Instantly demanded how he would acquitt himself of the felony aforesaid as by the Indictment aforesaid above against him Imposed says that of the felony aforesaid above against him Supposed he is guilty thereof and Every thing in the Indictment afd Expressly Confesseth &a Whereupon all and Singular the premisses by the Court here seen heard and fully understood Thereupon the Court here according to act of assembly in Such Case made and provided valued the pair of Spurrs in the Indictment afd mentioned to Eight pounds of tobacco It is thereupon Considered by the Justices here that the said Jeremiah Lilley pay unto Littleton Townsend the party afd deprived fourfold of the Value of the Spurrs afd stolen amounting in the Whole to thirty two pounds of tobacco and that the said Jeremiah Lilley be whipt at the publick whiping post with five Stripes on the bare back well Laid on untill the blood appear and that he stand Immediately One quarter of an hour and that he be taken &a and thereupon as to the Corporall punishment aforesaid Command is given to the Sheriff of Somerset County that he doe thereof Immediate Execution according to the Judgment afd Rendered by whiping of the afd Jeremiah Lilley at the publick whiping post with five Stripes on the Bare back well Laid on untill the blood appear and by Setting him in the pillowry Immediately one quarter of an hour and afterwards in the Same Court Came the said Sheriff and made return that he had done the Execution of the Judgm.t afd as to the Corporall punishment afd he was Commanded &a
Cordwainer the first day of January in the Year of Our Lord God Seventeen hundred and thirty five with force and arms at the parish aforesaid in the County afd within the Jurisdiction of this Court One pair of Boots of the Value of the Value of One hundred pounds of tobacco One Red Riding Coat of the Value of three hundred pounds of tobacco and one pair of Stockins of the Value of Twenty pounds of tobacco of the goods and Chattells of Joseph Macclester then and there being found then and there feloniously did Steal take and bear away Contrary to the peace of the said Lord Proprietary that now is his good rule and Government and against the form of the act of assembly in Such Case Lately made and provided &a Test Joseph MaClester Francis Porter and Joshua Merrill On the backside of the foregoing bill of Indictment it was thus Endorsed Billa Vera Ed.m Hough Foreman Thereupon Command was given to the Sheriff of Somerset ^County^ that he Should take the said Jeremiah Lilley if &.a to answer &.a and afterwards to witt the Sixteenth day of March anno Dom One thousand |
