136 Thereupon a Certain Thomas Adams of Somerset County planter present here in Court in his proper person undertook for the said John Jenckins and acknowledged himselfe Indebted himselfe Indebted unto his Lordship the Lord proprietary in the Sum of Twenty pounds sterling of his goods and Chattells Lands and tenements to the Use of his said Lordship his heirs and Successors to be made and Levied If it happen that the said John Jenckins do not make his personall appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of June next and do not then and there give such Evidence as he knows on behalfe of his said Lordship against the afd John Deal and Thomas Blizard of and Concerning a Certain trespass and assault by them Supposed to be Committed and done and do depart the Same Court without Leave &a
the twentieth day of October in the Year of Our Lord God Seventeen hundred and thirty five with force and Arms at the parish aforesaid in the County afd within the Jurisdiction of this COurt one Cold Chisel of the Value of twenty pounds of tobacco of the goods and Chattells of Capt John Tunstall there being found then and there feloniously did steal take and bear away Contrary to the peace of the said Lord proprietary that now is his good rule and Government and against the form of the act of assembly in such Case lately made and provided Test John Tunstall On the backside of the foregoing Bill of Indictment it was thus endorsed in those words following viz.t Billa Vera Samuel Wilson Thereupon Command was given to the Sheriff of Somerset County that he Should take the said Timothy Haley if &.a to answer &.a and afterwards to witt the Sixteenth day of March anno Dom One thousand seven hundred and thirty five before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in and for the Same County Came the said Timothy Haley in his proper person under Custody of the Sheriff of Somerset County into whose Custody before that time was taken for the Cause aforesaid and being by the said Sheriff led to the barr; and had a hearing of the Indictment afd who says that he is not Guilty thereof and of this he putts himselfe upon the Country and William Goldsborough Gent his Lordships attorney; and who for his said Lordship in that part Followeth Likewise Thereupon it is Commanded the Sheriff of Somerset County that Immediately he should Cause to Come here before the Justices afd Twelve &a by whom &a and who neither &a to recognize &a because |
