135 as it seems to the Court here that the said Betty Game is a black woman and doth not Come within the act of assembly in such Case made and provided for the punishment of adultery and fornication &a Wherefore it is Considered by the Court here that the afd Betty Game be thereof Quiett & goe thereof without day &a Likewise it is Considered that the afd Betty Game give Security for the payment of the Severall officers their fees due by Occasion of the premisses and thereupon Jos: MaClester of Somerset County Gent present herein Court undertook for the said Betty Game to pay the Severall Officers Fees due by means of the premises afd &a
Thereupon Command was given to the Sheriff of Somerset County that he Should take the said Abraham Heath if &a to answer &a and afterwards to witt the Sixteenth day of March anno Dom one thousand Seven hundred and thirty five before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in the Same County Came the said Abraham Heath in his own proper person and had a hearing of the presentment afd and being Instantly demanded how he would acquitt himselfe of the premisses afd above upon him Imposed saith that of the premisses afd above upon him Imposed saith that he is Guilty thereof whereupon all and Singular the premisses by the Court here being seen heard and fully understood &.a It is Considered by the Court here that the afd Abraham Heath pay unto his Lordship the Right honourable the Lord proprietary for his fine by the Court here upon him Imposed for and by occasion of the trespass and assault aforesaid whereof in form afd he is Convict two shillings and Six pence Curr.t money of Maryland & that the said Abraham Heath be taken to Satisfie his said Lordship of the fine afd and is discharged paying of Fees &a
and they and their Securitys are accordingly discharged Whereupon the said John Deal and Thomas Blizard are ordered to give recognizance in thirty pounds Sterling Each for their good behaviour and appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of June Next &a whereupon |
