134 Currant money of Maryland Early and Every Year he Shall keep such ordinary or hous of Entertainment as afd &a Likewise the said Thomas Holbrook with Joseph McClester and Francis Porter his Securitys afd all present here in Court as afd acknowledged themselves Indebted unto his Said Lordship the Lord proprietary afd in the Sum of forty pounds Curr.t money of Maryland of their goods and Chattells Lands and tenements Joyntly ^& Severallly^ to the use of his said Lordship his heirs & Successors to be made and Levied If it happen that the said Tho.s Holbrook doe not keep good rules and orders and do Suffer Idle Loose or disorderly persons to tipple game or Committ other disorders or Irregularityes in his ordinary or house of Entertainment during the time that he Shall keep the Same: Contrary to the true Intent and meaning of the act of assembly in Such Case made and provided &a
this Court did Committ fornication with a Certain person to the Jurors afd unknown and did permitt the same unknown person than and there to have Carnall knowledge of her body and to begett then and there a bastard Child on the body of her the Same Mary to the high displeasure of almighty God to the Evill Example of all Others in such Case offending Contrary to the peace of the said Lord proprietary that now is his good rule and government ^and^ against the form of the act of assembly in Such Case made & provided &a Testis Dowty Collier On the backside of the foregoeing Bill of Indictment it was thus Endorsed Billa Vera Sam.ll Wilson foreman Thereupon Command was given to the Sheriff of Somerset County that he should take the said Mary McGuire if &.a to answer &.a and afterwards to witt the sixteenth day of March anno Dom one thousand seven hundred and thirty five before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in the Same County Came the said Mary McGuire in her proper person and had a hearing of the Indictment afd and being thereupon Instantly demanded how he would acquitt herself of the premises afd as by the Indictment afd above upon her is Imposed says that of the premisses aforesaid as by the Indictment afd Above upon her is Imposed she is guilty thereof and thereupon the said Mary McGuire in due form makes oath that a Certain John McClester of Somerset County Gent is the father and begetter of the Bastard Child she stood Indicted for and for as much as the said Mary Maguire hath nothing to pay her fine for the fact afd &a Therefore it is Considered by the Justices here that the said Mary McGuire be whipt with tenn Lashes on the bare back well Laid on untill the blood appear and that she be taken &.a and thereupon as |
