(126) Imparle hereuntill next Court and he hath it and the same day is given to the aforesaid Thomas Fletcher and Sarah his wife herealso &.a Att which said next Court to witt the Eighteenth day of November Ann: Dom: One thousand seven hundred and thirty five came againe as well the af.d Thomas Fletcher and Sarah his wife as the af.d Rebecca Obryan by their attorneys af.d and because the aforesaid Thomas Fletcher and Sarah his wife did not declare against the aforesaid Rebecca Obryan in the plea aforesaid Therefore they and their pledges of prosecuting be in mercy and that the plantifs name pledges &.a and that the aforesaid Rebecca Obryan recover against the aforesaid Thomas Fletcher and Sarah his wife her damages by Occasion of the premisses to One hundred 172 and Seventy Two pounds of tobacco to the same Rebecca Obryan by discretion of the Justices here at her request for her Costs and Charges in that part Sustained according to the form of the statute in such Case lately made and provided by the Court here adjudged &.a
Court of Somerset to be held at dividing Creek the third Tuesday of August then next to answer unto Thomas Bluett of a plea that he render unto him thirteen thousand & fourteen pounds of tobacco which to him he oweth and unjustly detaineth &.a and that thereof he should not fail &.a Att which said third Tuesday of August to witt the nineteenth of y.e same month Ann: Dom: One thousand Seven hundred and thirty five being y.e day of the return of the said writt cometh the said Thomas Bluett by Will.m Goldsborough his attorney and the Sheriff of Somerset County to whome the foregoing writt was directed likewise cometh and maketh return thereof to the Court here Endorsed in these words Following Vizt Cepi Corpus P Jos: M.aClester sher And the aforesaid Joshua Caldwell by George Douglas his attorney cometh and defendeth the force and Injury when &.a and prays leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the aforesaid Thomas Bluett herealso &.a Att which said next Court to witt the Eighteenth day of November Ann: Dom: One thousand Seven hundred and thirty give came againe as well the aforesaid Thomas Bluett as the aforesaid Joshua Caldwell by their attorneys aforesaid and because the aforesaid Thomas Bluett did not declare against the aforesaid Joshua Caldwell in the plea aforesaid Therefore he and his pledges of prosecuting be in mercy and that the plantife name pledges &.a and that the aforesaid Joshua Caldwell recover against the aforesaid Thomas Bluett his damages by occasion of the premisses to 264 Two hundred & Sixty four pounds of tobacco to the same Joshua Caldwell by discretion of the Justices here at his request for his Costs and Charges in that part sustained according to the form of the statute in such Case lately made and provided by the Court here adjudged &.a |
