prison of the Sheriff of Somerset County in satisfaction thereof or
that he the said John Persons will do the same for him &a

    Whereupon the said David Smith in his own proper ^person^ cometh and
defendeth the force and Injury when &.a and saith that he cannot gainsay
the action af.d of the af.d John Williams nor can he say but that
he did assume upon himself in manner and form as the aforesaid
John Williams above against him hath complained and as to the
damage of the same John Williams by him by occasion of the
premisses in that part Sustained the same David Smith saith
and Confesseth that the af.d John Williams hath sustained damages
by occasion of the premisses beyond his Costs and Charges by him
about his suit in that part apposed to Nineteen pounds six shillings
and Seven pence Current money of Maryland and not more
and because the af.d John Williams denys not this but the same
allegation Confesseth to be true prays Judgment for those damages
above Confessed together with his Costs and Charges af.d to him to
be adjudged &a

    Therefore by Consent of the parties af.d it is Considered by the Court
here that the aforesaid John Williams recover against the af.d
David Smith ^his^ damages af.d to the af.d Ninteen pounds six shillings
and Seven pence ^Currant money of Maryland^ in form af.d Confessed as also four hundred & Nine
387                        pounds of tobacco for his Costs and Charges af.d
to the same John Williams by the Court here and Consent of the
parties af.d adjudged and the af.d defendant in mercy &.a

                                     Thomas Gray late of Somerset County Marriner
was attached to answer was attached to answer unto William Camplin
of a plea of Trespass upon the Case &a
       And whereupon the said William by Robert Jenckins Henry his
attorney complains that whereas the aforesaid Thomas the fifteenth
day of March Ann: Dom: One thousand Seven hundred thirty and
four at Somerset County within the Jurisdiction of this Court was Indebted
unto the said William in the sum of twenty pounds Sixteen
Shillings and one penny Current Money of Maryland for divers good
wares and Merchandizes by the same William to the said Thomas at
the Especial instance and request of the said Thomas before that time
sold & delivered as by Account herewith into Court brought may
appear and so thereof afterward (to wit) the same day and year aforesaid
at the place af.d upon himself did assume and to the said William
then and there faithfully did promise that when afterwards he
should be thereunto requested he would well and faithfully pay &
Content and altho' the said Thomas thirteen pounds Eight shillings
