attorney complains for that whereas the said David Smith on the twenty on the twenty third day of May in the Year of our Lord One thousand Seven hundred and thirty four at Someret County afores.d ^and^ within the Jurisdiction of this Court was indebted to the said John Williams in the sum of Ninteen pounds six Shillings & Seven pence Current money of Maryland for divers Goods wares & Merchandizes of the said John Williams by him before that time sold and delivered to the said David Smith at his Special Instance & request as by an Acc.t hereto Annexed may more fully & at large appear and being so indebted the said David afterwards (to wit) the same day and year at Somerset County afores.d in Consideration thereof then and there undertook & faithfully promis'd that he the said David Smith would well & truly content and pay to the said John the said Sum of Nineteen pounds Six shillings & Seven pence when ever after he should be thereto required Nevertheless the said David not regarding his promise made in the manner as above but contriving and fraudulently intending craftily & subtilly to deceive and defraud the said John in this particular hath not paid the said Sum or any part thereof to the said John nor in any manner howsoever made him Satisfaction for the same altho' the said David hath been thereto required by the said John afterwards (to witt) on the first day of June in the year above mentioned & often afterwards at Somerset County aforesaid; but the said David hitherto hath & still doth refuse so to do whereupon he the said John Saith that he is thereby injur'd & Endamaged to the value of thirty pounds and therefore brings suit &.a pledges &.a John Doe & Rich.d Roe
for the said David Smith and assumed upon himselfe (Likewise the s.d David Smith assumed upon himselfe) that if in Case the said John Williams should recover Judgment in the plea af.d against the said David Smith or that the said David Smith should be therein Convicted that then he the said David Smith should pay the Condemnation of the Court thereupon or render his body in Execution of Such Judgment to the (prison |
