116 promise and assumption aforesaid beyound his Costs and Charges by him about his suit in that part apposed to Four thousand and thirty two pounds of tobacco and ten pounds four Shillings and ten pence Curr.t mony of Maryland and becaus the Justices here of their Judgment of and upon the premisses aforesaid to Render as yett will advise day thereof is given to the aforesaid Robert and John before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of August next of their Judgment thereof to hear for that the Justices here thereof as yett &a Att which said next Court to witt the ninteenth day of August ann.o Dom One thousand seven hundred and thirty five Came againe as well the aforesaid Robert Bolton as the aforesaid John Brown by their attorneys aforesaid and because the Justices here of their Judgment of and upon the premisses aforesd to Render as Yett will advise day thereof is given to the aforesaid Robert and John before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of November next of their Judgmt thereof to hear for that the Justices here as Yett &a Att which said next Court to witt the Eighteenth day of November Anno Dom One thousand Seven hundred and thirty five Came againe as well the aforesaid Robert Bolton as the aforesaid Jn.o Brown by their attorneys aforesaid and whereupon the premisses being seen and by the Justices here fully understood &.a Therefore it is Considered that the aforesaid Robert Bolton Recover against the afd John Brown his damages aforesaid by the Jurors afd in form aforesaid assessed as also Nine hundred 930 & Fifty two pounds of tobacco for his Costs and Charges to the Same Rob.t by the court here of his assent adjudged which certain damages in the whole do amount to ten pounds four Shillings and ten pence Curr.t money and pounds of tob.o and the afd deft in mercy &a
to be held at dividing Creek the third Tuesday of August then next to answer unto John Singleton of a plea of trespass upon the Case &.a And that thereof he should not fail &.a Att which said third Tuesday of August to witt the Nineteenth day of the same moth Ann: Dom: One thousand Seven hundred and thirty five being the day of the return of the said writt cometh the said John Singleton by Robert Jenckins Henry his attorney and the Sheriff of Somerset County to whom the foregoing writt was directed likewise comes & makes return thereof to the Court here Endorsed in these Words Following Viz.t Cepi Corpus P Jos: M.ccClester Sher whereupon |
