act of assembly in that Case made and provided before me one of his Ldships Justices of the peace this 1.st day of May 1735 Ed: Rownd Whereupon the said John Brown present herein Court in his proper person is by the same Court adjudged to give special bail to the action af.d Thereupon a Certain Thomas Fletcher late of Somerset County Gent came hereinto Court in his proper person and undertook for the said John Brown and assumed upon himselfe (Likewise the said John Brown assumed upon himselfe) that if in Case the said Robert Bolton should recover Judgment in the plea af.d against the said John Brown or that the said John Brown should be therein Convicted that then he the said John Brown should pay the Condemnation of the Court thereupon or render his body in Execution of such Judgment to the prison of the Sheriff of Somerset County in satisfaction thereof or that he the said Thomas Fletcher will do the same for him &.a Whereupon the af.d John Brown by William Beckingham his attorney cometh & defendeth the force and Injury when &.a and saith that he did not assume upon himself in manner & form as the af.d Robert above against him hath declared & of this he puts himself upon the Country &.a and the af.d plf.t in like manner Thereupon it is Commanded the Sheriff of Somerset County that Immediately he should Cause to come here before the Justices of his Lordships County Court of Somerset now sitting at dividing Creek in the County af.d twelve &.a by whom &.a and who neither &.a to recognize &.a because as well &.a and afterwards Immediately came thereof the Jury &.a and the Jurors of that same Jury by Joseph M.ccClester Gent Sheriff of the County af.d to this Impannelled being called came to witt John Waters, Thomas Waller, Angello Atkinson, Jonathan Sturgis, George Benston, James Breeman, William Mills, Richard Chambers, James Nearn John Lane, Archibald White, and Moses Chaille who to say the truth of the premisses aforesaid being duely Elected tryed and Sworn upon their ^oath^ do say that the aforesaid John Brown did assume upon himselfe in manner and form as the said Robert Bolton above against him hath Complained and assessed the damage of the same Robert by him by occasion of the Non performance of the promise |
