November Court        1735                 117

Whereupon the said sheriff altho' Solemnly Called brings not in the body of the said John Britt
according to the return of the writt in the plea aforesaid   thereupon at the prayer of the said
Sheriff to witt Joseph MccClester Gent day is given unto him untill next Court to be held for Somerset
County at dividing Creek the third Tuesday of November Next to being in the said John Britt
to answer unto the Said John Singleton in the plea afd as followeth viz.t

    Att which said next Court to witt the Eighteenth day of November being the third Tuesday
of the Same month anno Dom One thousand Seven hundred and Thirty five Came againe the
said John Singleton by his attorney afd and Likewise Came hereinto Court in his proper
person a Certain John Brown of Somerset County Carpenter and undertook for the Said John
Britt and assumed upon that if in Case the said John Singleton Should recover Judgm.t in the
plea aforesaid against the Said John Britt or that the said John Britt should be therein Convict
that then he the said John Britt should pay the Condemnation of the Court thereupon or render his
body to the Custody of the Sheriff of Somerset County in Satisfaction thereof or that he the said
John Brown will do the Same for him &a

             Whereupon the said John Singleton by his attorney afd Complained against the Said John
Britt in the plea aforesaid as Followeth vizt      Somerset County ss.t John Britt late
of Somerset County planter was attached to answer unto John Singleton
of a plea of trespass upon the Case &.a

    And whereupon the said John Singleton by Robert Jenckins
Henry his attorney Complains that whereas the aforesaid John Britt
after the first day of May Ann: Dom: One thousand Seven hundred
and five (to witt) the twenty third day of May in the year of our
Lord Seventeen hundred thirty and four at Somerset County af.d
within the Jurisdiction of this Court made his certain note in
writing called a promissory note with his own proper hand thereunto
Subscribed bearing date the same day and year last af.d
and the same note to the same John Singleton then and there did deliver
by which said note the same John Britt did promise to pay to the
same John Singleton or his order on demand the sum of two pounds
Eleven Shillings and seven pence Cash Current of Maryland and
one pound five Shillings and three pence Countrey pay for value
received and the same John Singleton in fact saith that he the
said John Singleton at any time hitherto hath not Ordered the
aforesaid two pounds Eleven Shillings and seven pence and one
pound five Shillings and three pence or any part of either of
the said Sums in the note aforesaid Contained to be paid to any
person whatsoever by reason of which said promissary note and
