in acc.^t as by acc.^t thereof hereunto annexed may in Court appear
and being so thereof Indebted the s.^d John in Consideration thereof
the day & year afores.^d at the County afores.^d upon himself did
assume and to the s.^d Robert then & there did faithfully promise
that he the s.^d John the afores.^d Four thousand & thirty two pounds
of tobacco and tenn pounds Four Shillings & tenn pence Curr.^t
money afores.^d to the s.^d Robert when he should be thereunto
requested he would well & faithfully pay & Content and altho'
the s.^d John Eight Shillings & Four pence pcell of the aforesaid
Four thousand & thirty two pounds of tobacco and tenn pounds
four Shillings & tenn pence curr.^t money afores.^d to the said
Robert he hath paid & satisfied Yett as to Four thousand and
thirty two pounds of tobacco and Nine pounds Sixteen Shillings
& Six pence residue thereof the s.^d John his promise and
assumption afores.^d in forme afores.^d made nothing regarding
but plotting & fraudulently intending the s.^d Robert in that part
craftilly and subtilly to deceive and defraud the s.^d Four thousand
& thirty two pounds of tobacco & Nine pounds Sixteen Shillings
& Six pence to the s.^d Robert hath not paid or Contented altho'
the same to do the s.^d John by the s.^d Robert on the afores.^d thirtieth
day of April in the year afores.^d & often afterwards at Somerset
County afores.^d he was thereunto requested but the same to him
hitherto to pay hath refused and still doth refuse and deny to
the damage of the s.^d Robert Bolton of Eight thousand pounds
of tobacco and Nineteen pounds curr.^t money of Maryland
and thereupon he brings Suite &.^a Pledges &.^a Jn^o Doe R: Roe
