and to charge it without further advise to the acc.t of him the s.d
RIchard Waters which same third bill of Exchange the first & second
bills of Exchange of the same tenor & date before sight of them
had by the s.d Jonathan Scarth and the money by them appointed
to be paid not being paid to the s.d Alexander Wordie M.rs
Henry and John Sperling of London Merch.ts or order by order of
the s.d Alexander Wordie in his life time to witt on the Eighth
day of October Ann: Dom: Seventeen hundred & thirty one at
London afores.d Viz.t at Somerset County afores.d within y.e Jur
af.d did request y.e af.d Jonathan Scarth to accept the aforesaid
third bill of Exchange and to pay the money therein mentioned
for the use of the s.d Alexander Wordie according to the tenor
of the s.d Bill which s.d third bill of Exchange the s.d Jonathan
Scarth then & there to accept or the money therein mentioned
to pay hath wholly refused & hath always hitherto refused tho'
often requested by the s.d M.rs John & Henry Sperling by
the order of the s.d Alexander Wordie in his life time the s.d third
bill of Exchange the first & Second of the same tenor & date
being unpaid after the Expiration of the thirty days therein
mentioned for payment to witt the Nineteenth day of November
Ann: Dom: Seventeen hundred & thirty one afores.d at London
afores.d to witt at Somerset County afores.d according to the Custom
of Merchants afores.d did protest or cause to be protested and
thereof afterwards the s.d Susannah whilst she was sole after
the decease of the s.d Alexander Wordie to witt on the first
day of May Ann: Dom: Seventeen hundred & thirty two at
Somerset County afores.d to the s.d Richard gave notice and whereas
by the use & Custom afores.d by all ye time afores.d used and
approved all persons making any bill or bills of Exchange in
Case of y.e non payment of y.e money in such bill mentioned
by the pson directed to pay y.e same & y.e s.d bill being protested
are & have been chargeable with y.e payment as well the
money in such bill or bills mentioned to the pson appointed
by the s.d bill or bills to receive the same together with all
Cost damages & Interest Occasioned by the non payment of y.e
money in such bill or bills mentioned and being so therewith
chargeable the s.d Richard in Consideration thereof the day &
year last mentioned at Somrsett County afores.d within the Jur
afores.d upon himself assumed and to the s.d Susannah whilst
she was sole then & there did faithfully promise that he the s.d
Richard the s.d tenn pounds Sterling and the Cost damages and
Charges occasioned by the non payment thereof and the protesting
