Ann: Dom: one thousand Seven hundred and thirty five came againe
as well the af.d John Brett as the af.d John White by their attorneys
af.d and thereupon the said John White by his attorney af.d as before
the defends the force and Injury when &.a               and saith
Non assumpsit p.o patriam and the aforesaid John White prays that the aforesaid
John Brett may reply to his plea aforesaid  whereupon day is given to the same John Brett by the
Court here to reply to the aforesaid plea and Enter Issue in the plea aforesaid  And afterwards it being
the Same Form Cometh the Said John White here in Court by his attorney afd and the aforesaid John
Brett altho' Solemnly Called Cometh not nor is his writt and declaration afd further prosecuted against the
Same John White &a

                         Therefore it is Considered by the Court here that the aforesaid John Brett take nothing
by his writt and declaration aforesaid but that he and his pledges of prosecuting to witt John Doe
and Richard Roe be in mercy and that the aforesaid John White goe thereof without day &a and
further it is Considered that the afd John White Recover against the afd John Brett Six hundred
673   and Ninety five                         for his and Charges by his Costs and Charges by him about
his defence in that part Sustained to the Same John White by the Court here according to the form of the
Statute in such Case Lately made and provided adjudged and that the same John White have thereof

Robert Geddes & Susannah his wife Ex.rx of the
testament and last will of Alexander Wordie late
of y.e County afores.d ^deced^ of a plea of trespass upon the
Case &.a                                      And Whereupon the s.d Robert & Susannah
by Francis Allen their attorney Complains that whereas the said
Richard the Eleventh day of May Ann: Dom: Seventeen hundred
& twenty nine at Somerset County afores.d within the Jurisdiction
of this Court according to y.e Custom amongst Merchants in Great
Brittain and this province of Maryland used and approved the
custom whereof in the Memory of man is not to y.e Contrary made
and drew three Severall bills of Exchange in writing all of
the same tenor & date with his proper hand thereto Subscribed
bearing date the same day and year afores.d and the same bills to a
certain Jonathan Scarth Merchant in London directed by the
third of which bills the s.d Richard requested the s.d Jonathan
Scarth at thirty days after sight thereof his first nor second of
the same tenor & date paid to pay unto the afores.d Alexander Wordie
in his life time or order tenn pounds Sterling for Value reced
