(109) Att which said third Tuesday of November to witt the Eighteenth day of the same month Ann: Dom: One thousand Seven hundred and thirty five being the day of the return of the said writt came the said John Williams by his attorney af.d and the Sher of Somerset County to whom the foregoing writt was directed likewise cometh and maketh return thereof to the Court here Endorsed in these words Following Viz.t Non Est Inventus short [illegible] time P.r Joseph Macclester Sher Whereupon the said John Williams by his attorney af.d prays that forasmuch as he hath complyed with the law in order to an attachment he may have Judgment against the said Martin Fenton for his damages af.d by way of attachment according to act of assembly &.a Wherefore for that it Seems to the Court here that the said John Williams has Complyed with the law as alledged Therefore it is Considered by the Court here that the af.d John Williams recover against the af.d Martin Fenton his damages af.d to the aforesaid Sixty four pounds fifteen Shillings and five pence Current money of Maryland as also all Costs and Charges by the said John laid out and Expended by way of attachment against the goods Chattells rights or Creditts of the af.d Martin Fenton according to act of assembly in such Case made and provided &.a
Bell on the Fifteenth day of June in the year of our Lord God One thousand Seven hundred & thirty five at Somerset County af.d & within the Jurisdiction of this Court was indebted to the s.d John Dennis in the sum of Sixteen pounds Fourteen Shill.s and five pence Current money of Maryland for divers goods wares & Merchandizes of the said John Dennis by him before that time sold & delivered to y.e s.d John Bell at his Speciall Instance & request as by an Acco.t hereto annexed may more fully at large appear & being so thereof indebted the said John Bell afterwards (to wit) the same day and year at Somerset County aforesaid in Consideration thereof then and there undertook and faithfully promis'd that he the said John Bell would well & truly content and pay to the said John Dennis Jun.r the said Sum of sixteen pounds Fourteen Shill.s and five pence whenever afterwards he should be thereunto requested Nevertheless the said John Bell not regarding his promise and made in the manner as above but plotting and fraudulently intending craftily and Subtilly to deceive & defraud the said John Dennis Jn.r in this particular hath not paid the said sum or any part thereof to the (said |
