properly chargeable in account as by account herewith
into Court brought may appear & so thereof being Indebted
y.e s.d Martin in Consideration thereof afterwards (to witt) y.e
same day and year aforesaid at the place af.d upon himself
did assume & to y.e s.d John then & there faithfully did promise
that when afterwards he should be thereunto requested he
would well & faithfully pay and Content and altho' y.e s.d Martin
five Shillings and two pence parcell of the af.d Sixty five
pounds and Seven pence half penny he hath paid & satisfied
yet as to Sixty four pounds fifteen Shillings and five pence
half penny residue of the af.d Sixty five pounds and Seven
pence half penny his promise and assumption af.d in form
af.d made little regarding but plotting and fraudulently Intending
the same John in that part craftily and Subtilly to
deceive and defraud the af.d Sixty five pounds fifteen Shillings
and five pence half penny nor any part thereof to y.e same
John he hath paid or him for y.e same any way contented altho'
the said Martin afterwards (to witt) the same day and year af.d
at the County af.d & within the Jur af.d by him y.e s.d John
was thereunto requested but the s.d Martin the same to do
hitherto altogether hath refused and still doth refuse whereby
the same John sayeth he is y.e worse and hath damage to the
Value of One hundred pounds Current money of Maryland
and thereupon he brings Suit &.a      pledges & Jn.o Doe R:d Roe
