afterwards the said John Aydelott present herein Court as af.d
relinquisheth his Verification af.d by him above alledged and says
that he cannot Gainsay the action af.d of the af.d John Watson nor
can he say but that he did assume upon himself in manner and form
as the af.d John Watson above against him hath complained and as
to the damage of the same John Watson by him by Occasion of the
premisses in that part Sustained the same John Aydelott saith and
Confesseth that the af.d John Watson hath sustained damages by
Occasion of the premisses beyond his Costs and Charges by him about
his suit in that part apposed to Eight hundred and Eighty Eight
pounds of tobacco and not more and because the af.d John Watson denys
not this but the same allegation Confesseth to be true pray Judgment for
those damages above Confessed together with his Costs and Charges af.d to
him to be adjudged &.a

    Therefore by Consent of the parties aforesaid it is Considered by the Court here
that the af.d John Watson recover against the af.d John Aydelott his damages
af.d to the af.d Eight hundred and Eighty Eight pounds of tobacco in form
af.d Confessed as also Eight hundred & thirty Nine                          pounds
of tobacco for his Costs and Charges aforesaid to the same John Watson

Command was given to the Sheriffe of Somerset County that
he should take Martin Fenton late of Somerset
County Cordwainer if he should be found in
his bailywick and him should safe keep so that
he might have his body before the Justices of his Lordships County Court
of Somerset to be held at dividing Creek the third Tuesday of November
next to Answer unto John Williams of a plea of trespass upon the Case &.a
And that thereof he should not fail &.a

    And the aforesaid John Williams by Robert Jenckins Henry his attorney
complaineth against the af.d Martin Fenton in the plea af.d as
Followeth Viz.t

Somerset County ss  Martin Fenton late of Somerset County Cordwainer
was attached to answer unto John Williams in a plea of trespass upon
the Case &.a                  And Whereupon y.e s.d John by Robert
y.e Second day of October Ann: Dom One thousand Seven hundred
thirty & Five at Somrset County within the Jur of this Court was
Indebted unto the said John in the sum of Sixty five pounds and
Seven pence half penny Current money of Maryland for sundrys
