November Court           1735            (108)

& year last mentioned at the County af.d & often since that time
by the said John Watson the said John Aydelott was required) whereupon
the said John Watson says he is the worse & damage hath to
the Value of Seventeen hundred pounds of tobacco & thereof he
brings Suit &.a                           Pledges &.a Jn.o Doe R:d Roe

         A Copy of the foregoing declaration was made & sent to be
served on the defendant with the writt in the plea af.d according to
act of assembly in such Case made and provided &.a

    Att which said third Tuesday of November to witt the Eighteenth
day of the same month Ann: Dom: One thousand Seven hundred
and thirty five being the day of the return of the same writt came
the said John Watson by his attorney af.d and the Sheriff of Somerset
County to whome the foregoing writt was directed likewise cometh
and maketh return thereof to the court here Endorsed ^in these words following^ Viz.t
Cepi Corpus declaration in time                     p Jos: M.cClester Sher

    Whereupon the said John Aydelott present herein Court in his
proper person is by the same Court adjudged to give Speciall
Bail to the action aforesaid  Thereupon a Certain John Pope late
of Somerset County planter came hereinto Court in his proper
person and undertook for the said John Aydelott and assumed
upon himself (Likewise the said John Aydelott assumed upon
himselfe) that if in Case the said John Watson should recover Judgment
in the plea aforesaid against the said John Aydelott or that the
said John Aydelott should be therein Convicted that then he the said John
Aydelott should pay the Condemnation of the Court thereupon or render
his body in Execution of such Judgment to the prison of the
Sheriff of Somerset County in satisfaction thereof or that he the
said John Pope will do the same for him &.a

And thereupon the said John Aydelott by Francis Allen his attorney prays that the afd
John Watson may give Security for Costs in Case nonsuite be Obtained against him in the plea afd which
is by the Court granted   Whereupon a Certain James Martin of Somerset County Gent present
here in Court in his proper person undertakes for the Said John Watson that in Case he be nonsuited
in the plea afd or otherwise Legally Cast that then the said John Watson shall pay the Condemnation
of the Court thereupon and all Costs accrewing thereon to the said John Watson or that he the said
James Martin will do the Same for him &a                 And the afd John Aydelott by Francis
Allen his attorney comes and defends the force and Injury when &.a and
saith that he did not assume upon himself in manner and form as
y.e s.d John Watson above ag.t him hath Complained and of this he
puts himself upon the Country &.a                                 And Whereupon
