105 the aforesaid three pounds Currant money of Maryland and al Costs and Charges accrewed by means of the attachment aforesaid &a Thereupon a Certain William Beckingham of Somerset County Gent present herein Court in his proper person undertook for the said Day and Andrew Scott according to act of assembly in Such Case made and provided that in Case the said John Hendry do at any time within a year and a day appear and make all or any part of the said Day and Andw Scotts Claim against him appear to be satisfied or otherwise to be made before the Laying of this attachment that then the said And Day and Andw Scott shall make restitution unto him the said Jno Hendry of all or Such part thereof as shall be made appear to be undue &a or that he the Said William Beckingham will do the Same for them &a Therefore it is Considered by the Justices here that the aforesaid Hose of the Value of Eight hundred pounds of tob.o so as aforesaid attached be Condemned as of the Rights and Creditts of the aforesaid John Hendry towards Satisfying unto the Said Day Scott and Andrew Scott the aforesaid three pounds Curr.t money of maryland as also all Costs and Charges accrewed by means of the attachment aforesaid and that he have thereof Execution &a
August 20.th 1735 Then Came John Lynch before me the Subscriber One of the Lord Prorys Justices of the peace for the County of Somerset and made oath on the holy Evangelist of almighty God that the account above against William Jennings is Just and true and that he never Received any part or parcell thereof nor Security nor any thing in Satisfaction for the Same to the best of his knowledge Sworn before me the day and Year above William Stoughton Whereas John Lynch hath this day made appear to me the Subscriber one of the Lord Proprietarys Justices of the peace for the County of Somerset upon Oath that William Jennings is Indebted to him the Sum of five hundred and four pounds of tobacco and also that the said William Jennings is fled the province so that he Cannot be brought to Justice These are to require you Tho.s Hayward Clerk of Somerset County to Issue attachment against the goods Chattells Rights and Creditts of the said William Jennings for the said Sum of five hundred and four pounds of tobacco according to the directions of the act of assembly of this province in that Case made and provided and this shall be your Warrent Given under my hand and Seal this 20.th day of August ann.o Dom 1735 To Thomas Hayward Cler of Somerset County Will.m Stoughton In pursuance to an act of assembly of this province now in force and in Obediance to the above said |
