105 to be held at dividing Creek the third tuesday of November next then and there to be Condemned according to act of assembly to and for the Use of a Certain Day Scott and Andrew Scott unless the said John Hendry by himselfe or his attorney shall appear and answer unto the said Day Scott and Andrew Scott in a plea of trespass upon the Case &.a according to Law and that by good & Lawfull men of your bailywick you make known unto the person or persons in whose hands you make the Same attachment that he She or they be and appear before our Justices of Our County Court of Somerset to be held as aforesaid to shew Cause if any he she or they have why the Same goods Chattells rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to act of assembly in Such Case made according to act of assembly in Such Case made and provided if to him her or them it shall seem meet and how you shall Execute ^this writt^ that you make known unto our said Justices at the day and place aforesaid and have you then and there this Writt Wittness Robert King Gent Chiefe Justice of Our Said Court the 21.st day of August in the 20.th Year of our dominion &.a anno Dom 1735 Att Which said third Tuesday of November to witt the Eighteenth day of the same moth anno Dom ne thousand seven hundred & thirty five being the day of the return of the same Writt Came the Said Day Scott and Andw Scott by William Goldsborough their attorney and the Sheriff of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following vizt I certifie that by Vertue of the within Writt I have on the twenty Sixth day of September seventeen hundred & thirty five at Somerset County attached of the goods and Chattells of the within named James Hendry one horse of the value of Eight hundred pounds of tob.o as appears by the schedule hereunto annexed to have been appraised in due form of Law the appraisers having been qualified before me Jos: MccClester sher September y.e 26.th 1735 We Joseph Wailes John Shiles, Robert Collier and Mathias Dashiell being somoned by the Sheriff to appraise the goods and Chattells of John Hendry a pedlar on an attachment against his goods for Day and Andw: Scott we do according to the oath in Such Case doe value the following goods viz.t To a large Black Horse Very Old 800.ll tobacco Joseph Wailes John Shiles Robt Collier Mathias Dashiell Whereupon the said Day Scott and Andrew Scott by their attorney afd prays that upon giving Security according to act of assembly in Such Case made and provided the afd Horse of the the value of Eight hundred pounds of tobacco so as afd attached may be Condemned as the goods and Chattells of the said Jno Hendry towards satisfying unto the said Day Scott and Andw: Scott the |
