104 forbearance of the payment of the said Six pounds and fourteen Shillings by the aforesaid John White in manner and form aforesaid taken Exacted and received on the day of payment aforesaid did Exceed the rate of Six pounds for the Loan of and forbearance of one hundred pounds for One Year Contrary to the act of assembly aforesaid &.a Wherefore the Said Lord Proprietary for the Same Lord Proprietary prayeth the advice of the Court here in the Premisses and that due process of Law in this part against the aforesaid John White may be made to answer unto the said Lord Proprietary of and upon the premisses &.a Test Thomas BIllings Jno Britt Thereupon Command was given to the Sheriff of Somerset County that he Should take the said John White if &.a to answer &.a And afterwards to witt the Eighteenth day of march anno Dom one thousand seven hundred and thirty four Came hereinto Court the said John White by Robert Jenckins Henry his attorney by the Speciall favour of the Court here admitted and defendeth the force and Injury when &.a and prays a hearing of the Information afd and to him it is read &.a which being read and heard the same John White prays Leave thereof to Imparle here untill next Court and he hath it and the Same day is given to his Lordships attorney who for his said Lordship in this part followeth also &a Att which said next Court to witt the seventeenth day of June anno Dom One thousand seven hundred and thirty five Cae againe as well the aforesaid William Goldsborough his Lordships attorney and who for his said Lordship in this part followeth as the said John White by his attorney afd and Whereupon the said John White prayeth further Leave thereof to Imparle here untill next Court and he hath it and the Same day is given to his Said Lordships attorney here also &a Att which said next Court to witt the ninteenth day of August anno Dom One thousand Seven hundred and thirty five Came againe as well the afd William Goldsborough his Lordships attorney and who for his said Lordship in this part followeth as the said John White by his attorney afd and whereupon the said John White prayeth further Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd his said Lordships attorney here also &a Att which said next Court to witt the Eighteenth day of November anno Dom one thousand seven hundred and thirty five Came againe as well the said William Goldsborough his Lordships attorney who for his said Lordship in this part followeth as the afd Jno White by his attorney afd and thereupon the said Jno White as before defends the force and Injury when &a and Saith that he is not Guilty of the premisses in the Information afd above upon him Imposed he is not Guilty thereof and of this he putts himselfe himselfe upon the Country and William Goldsborough who for his said Lordship in this behalfe followeth Likewise &a And hereupon afterwards |
