(102) bear away contrary to the peace of the said Lord proprietary that now is his good rule and Government and against the form of the act of assembly in such Case lately made and provided &a Test John Reddish, William Teague On the backside of the foregoing Bill of Indictment it was thus Endorsed vizt Billa vera John Purnall foreman ^thereupon Command was Given to the Sher of Somerset Coty that he should take ye sd Jno Callinan if &.a to answer &.a^ and afterwards to witt the Eighteenth day of November Anno Dom One thousand Seven hundred and thirty five before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in and for the Same County Came the said John Callinan in his proper person according to a Certain Recognizance by him and his security before acknowledged and being by the Sheriffe of the County afd set to the Barr had a hearing of the Indictment afd who says that he is not Guilty thereof and of this he putts himselfe upon the Country and William Goldsborough Gent his Lordships attorney and who for his said Lordship in that part Followeth Likewise Thereupon it is Commanded the Sheriffe of Somerset County that Immediately he Should Cause to Come here before the Justices aforesaid Twelve &.a by whom &.a and who neither &.a to Recognize &.a because as well &.a and afterwards Immediately came thereof the Jury &a and the Jurors of that Same Jury by Joseph MccClester Gent Sheriff of the County afd to this Impannelled being Called came to witt Mathew Hopkins John Williams William Fasit Philip Quinton Peter Claywell Thomas Pullet Joshua Porter John Paty John Webb John Perkins Richard Knight and George Howard who to say the truth of and upon the premisses afd being duely elected tryed and Sworn upon their Oath do Say that the said John Cullinan is Guilty of the felony ^afd^ whereof he stands Indicted in manner and form as above by the Indictment against him Supposed Wherefore it is Considered by the Justices here that the aforesaid John Callinan pay unto the afd John Reddish the part deprived four fould of the Value of the Money and book afd stolen amounting in the whole to twelve pounds Sixteen Shillings Curr.t money of Maryland and that the said John Callinan be whipt with twenty Stripes on the bare Back well Laid on untill the blood appear and that he stand Immediately in the pillowry halfe an hour and that he be taken &a and thereupon as to the Corporall punishment af Command is given to the Sheriff of Somerset County that he do thereof Immediate Execution according to the Judgment afd Rendered by whiping the afd John Cullinan at the Publick whiping post with twenty Strips on the Bare back well Laid on untill the blood appear and by setting him in the pillowry halfe an hour and afterwards in the same Court Came the said sheriffe and made Return that he had done the Execution of the Judgment afd as to the Corporall punishment aforesaid he was Commanded whereupon the said John Callinan ^present herein Court^ is ordered to give sery |
