1733 92 found by the Jurors afd may be Condemned in the hands of the said Heber Whittingham as of the rights and Credits of the said George Martin &a Therefore it is Considered by the Justices here that the afd thirty Six pounds four shillings Currant money and One thousand pounds of tobacco so as afd found by the Jurors afd be Condemned in the hands of the said Heber Whittingham as of the Rights and Creditts of the said George Martin towards Satisfying unto the said William Jones his damages and Costs accrewed on the Obtaining of the attachment afd as also it is Considered by the Justices here that the afd William Jones Recover against the said Heber Whittingham 786 Seven hundred & Eighty Six pounds of tobacco for his Costs and Charges to the same William by the court here of his assent adjudged and the afd deft in mercy &a
Enter and the trees thereon Lately Growing he did Cutt down and Consume and Other harmes to the said Johnson Hill then and there did to the great damage of the said Johnson Hill and against the peace of the Right Honourable the Lord proprietary of this province his good rule and Government &a And Whereupon the said Johnson by Francis Allen his attorney Complaines that the said Johnson by Francis Allen his attorney Complains that he said Philip the First day of October Anno Dominie Seventeen hundred and thirty with force and arms &a the Close of him the said Johnson called Sandy hill at Somerset County aforesaid Within the Jurisdiction of this Court he did break and enter and Sixty Oak Trees thereon Growing of the Value of three Shillings current mony of Maryland Each Tree he did Cutt down and Consume and Other harms to the said Johnson then and there did to the Great damage of the said Johnson and against the peace of the Right honourable the Lord proprietary of this province that now is his good rule and government &a and to the damage of the said Johnson of Nine pounds current mony aforesaid and thereof he brings suite &a Pledges &a John Doe R Roe And and the afd Philip Selby by William Beckingham his attorney Comes and defends the force and Injury when &a and prays leave thereof to Imparle here untill next Court and he hath it and the Same day is Given to the afd Johnson here also &a Att Which said next Court to witt the twenty first day of November anno Dom One thousand Seven hundred and thirty two Came again as well the afd Johnson Hill as the afd Philip Selby by their attorney aforesaid and whereupon the same Phillip prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is Given to the afd Johnson here also &a Att which said next Court to witt the twentieth day of march anno Dom one thousand Seven hundred and thirty three Came again as well the afd Johnson Hill as the afd Philip Selby by their attorneys afd and whereupon the Same Philip prays further LEave thereof to Imparle here untill next |
