1733 92 by their attorneys afd and whereupon the same Heber prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is given to the afd William Here also &a Att Which said next Court to witt the ninteenth day of June anno Dom One thousand Seven hundred and thirty three Came again as well the afd William Jones as the afd Heber Whittingham by their attorneys afd and whereupon the Same Heber prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is given to the afd ^William^ here also &a Att Which said next COurt to witt the twenty first day of august anno Dom One thousand Seven hundred and thirty three Came again as well the afd William Jones as the afd Heber Whittingham by their attorneys afd and whereupon the Same Heber prays further Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is Given to the afd William here also &a Att Which said next Court to witt the twentieth day of November anno Dom One thousand Seven hundred and thirty three Came againe as well the afd William Jones as the afd Heber Whittingham by their attorneys afd and whereupon the same Heber saith that the afd William Jones Condemnation of the premisses so as afd attached in his hands to have Ought not becaus he Saith that He the said Heber hath not nor at the day of the attachment afd or at any time Since hath had aga any of the goods Chattells rights or Creditts of the said George Martin in his hands and this he is read to verifie wherefore he prays Judgm.t if the afd William Jones Condemnation of the premises so as afd attached in his hands to have ought &a And the said William Saith that he by anything by the said Heber from Having Condemnation of the premises so as afd in his hands attached ought not to be barred because he saith that the said Heber at the day of the attachment afd had Sundry goods and Chattells Rights and Creditts of the said Geo: Martin in his hands and this he prays may be Inquired of by the Country and the afd plft in like manner Thereupon it is Commanded the Sher of Somerset County that Immediately he Should Cause to Come here before the Justices of his Lordship County Court of Somerset now Sitting at diving dividing Creek in and for the County afd twelve &a by whom &a and who neither &a to recognize &a because as well &a and afterwards Immediately Came thereof the Jury &a and the Jurors of that Same Jury by Joshua Caldwell Gent sher of the County ^afd^ to this being Impannelled being Called Came to witt William Handy, John Pope, W.m MccClamey W.m Colebourn, Samuel Gillett, Joshua |
