1733 91 of thirty Six pounds four shillings Currant mony of Maryland One thousand pounds of tobacco and when you have the Same attached or any part thereof the Same in your Custody safe keep so that you have the Same before our Justices of Our County Court of Somerset to be held at dividing Creek Creek the third tuesday of August next then and there ^to be^ Condemned according to act of assembly to and for the Use of a Certain William Jones Unless the said Geo: Martin by himselfe or his attorney shall appear and answer unto the said William Jones in a plea of trespass upon the Case &a According to Law and that by good and Lawfull men of your bailywick you make known unto the person or persons in whose hands you make the Same attachment that he she or they be and appear before Our Justices of Our County Court to be held as afd to shew Cause if any he she or they have why the same goods Chattells rights or Creditts so attached in his her or their Hands Ought not to be Condemned and Execution thereof had and made according to act of assembly in Such Case made and provided if to him her or them it shall Seem meet and how you shall Execute this writt that you make known unto Our Said Justices at the day and place afd and have you then and there this writt Wittness Robert King Gent Chiefe Justice of Our Said Court the twenty fourth day of June in the Eighteenth Year of Our dominion &a Anno Dom One thousand Seven hundred & thirty two Att which said third tuesday of August to witt the fifteenth day of the Same month Anno Dom One thousand Seven hundred and thirty two being the day of the return of the Said Writt Cometh the said William Jones by Francis Allen his attorney and the sher of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following viz.t By Vertue of the within Writt to me directed to the Justices within Mentioned I Certifie that I did attach on the second day of August One thousand seven hundred and thirty two in the hands of Heber Whittingham as the goods and Chattells of the within Named George Martin thirty Six pounds four shillings Currant Money of Maryland and One thousand pounds of tobacco and by John Dennis Jun.r and by Richard Roe honest and Lawfull men of my Bailywick I did make known unto the said Heber Whittingham that he be and appear at the time and place within Contained before the Justices within Mentioned to shew &a as by the within preceipt I am Commanded so answers Jos Caldwell sher And the said Heber Whittingham Garnishee of the afd George Martin by William Beckingham his attorney Comes and prays Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd William Jones here also &a Att which said Next Court to witt the twenty first day of November Anno Dom One thousand Seven hundred and thirty two Came againe as well the afd William Jones as the afd Heber Whittingham by their attorneys afd and Whereupon the same Heber prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is given to the afd William here also &a Att which said next Court to witt the twentieth day of March Anno Dom One thousand Seven hundred and thirty two Came againe as well the afd William Jones as the afd Heber Whittingham by |
