8 Lordships Justices at the day and place afd to shew &.c as within to him it was Commanded And the afd John Newbold so forewarned and at the same day being Solemnly Called Cometh not but Makes default &.c Whereupon the said John Scarbrough in his Own proper person prays that upon giveing Security according to act of assembly in such Case provided that the afd Twenty Six bushells of Indian Corn so as afd attached as of the Rights and Creditts of the said Samuel Waterhouse may be Condemned in the hands of the said John Newbold towards satisfying unto him his damages and all Costs and Charges accrewing by means of the same attachment Thereupon a Certain James Shirley of Somerset County Gent present here in Court undertakes for the said John Scarbrough according to act of assembly that if in Case the Said Samuel Waterhouse do at any time within a year and a day appear and make all or any part of the said John Scarbroughs Claim against him to be Satisfied or otherwise to be undue before the Laying of the attachment afd that than he the said John Scarbrough shall make Restitution unto him the said Samuel Waterhouse of all or such part thereof as shall be so made appear to be undue as afd &.c Or that he the said James Shirley will do it for him &.c Therefore it is Considered by the Court here that the afd Twenty Six Bushells of Indian Corn of the value of Eleven shillings and five pence and three hundred pounds of tobacco so as aforesaid attached be Condemned in the hands of the said John Newbold as of the Rights and Credits of the said Samuel Waterhouse to satisfie the Said John Scarbrough his damages and Costs acrewing upon the writt of attachment afd and that the said John Scarbrough have thereof his Execution against the said Jno Newbold according to act of assembly &.c
Somersett to be held at Dividing Creek the third Tuesday of June then Next to Answer unto William Wye of a plea of Trespass upon the Case &.c and that thereof he should not fail &.c Att which said Third Tuesday of June to witt the Nineteenth day of the Same Month Anno Dom one thousand seven hundred and thirty three Came the said William Wye by Francis Allen his Attorney and the sher of Somerset County to whom the foregoing writt was Directed Likewise Comes and makes Return thereof to the Court here Endorsed ^in these words following viz.t^ Cepie Corpus p Jos Caldwell Sher And Thereupon his Lordship the Right honrble the Lord Proprietary his Certain Writt of Habeas Corpus unto the Justices of his County Court of Somerset now here sendeth which said writt followeth in these words vizt Maryland ss Charles absolute Lord and Proprietary of the provinces of Maryland and avalon Lord Baron of Baltemore &.c To the Justices and sheriffe of Somerset County Court Greeting Whereas Nicholas Hodgson is detained in the prison of Our Said County under the Custody of you our said sher at the Suit of a Certain William Wye Clerk in a plea of trespass upon the Case which said plea as |
