(8) Is Actually Gone or Run away and is about to Remove his Effects out of this County to Deceive his Creditors You are hereby Required to Issue an attachment on behalf of John Scarbrough for the Sum as in the account here sent you proved with the Incident Costs and Charges according to the form of an Act of Assembly in such Case lately Made and provided and for your so Doing this shall be your warrant Wittness my hand this Twenty fourth day of March Annoq Dom seventeen hundred and thirty Two To Thomas Hayward Clk of Somerset County Jno Scott Pursuant to an act of assembly of this province now in force and in Obediance to the abovesaid warrant the following attachment was Issued against the goods Chattells rights or Credits of the afd Sam.l Waterhouse the tenor of which writt followeth in these words viz.t Somerset ss Charles absolute Lord and proprietary of the provinces of maryland and avalon Lord Baron of Baltemore &.c To the sherrife of Somerset County Greeting we command you that you attach any the goods Chattells Rights or Credits of Samuel Waterhouse late of Somerset County marriner if they shall be found in your bailywick to the value of Eleven shillings and five pence and three hundred pounds of tobacco and when you have the same attached or any part thereof the same in your Custody safe keep so that you have the same before Our Justices of Our County Court of Somerset to be held at dividing Creek the third tuesday of June next then and there to be Condemned according to act of assembly to and for the use of a Certain John Scarbrough according to act of assembly and that by good and Lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before our Justices of Our County Court of Somerset to be held as afd to shew Cause if any he she or they have why the same Goods Chattles Rights or Credits so attached in his her or their hands ought not to be Condemned and Execution thereof had and Made according to Act of Assembly in Such Case made and provided if to him her or them it shall seem meet and how you shall Execute this writt that you make known unto our said Justices before whome you make the same known at the same day and place aforesaid And this Writt Wittness Rob.t King Gent Chief Justice of our Said Court the twenty second day of March in the Eighteenth Year of our Dominion &.a Anno Dom one thousand seven hundred and thirty two Att which said third Tuesday of June to witt the ninteenth day of the same month Ann Dom One thousand Seven hundred and thirty three before the Justices of his Lordships County Court of Somerset held at dividing Creek in the County afd Came the afd John Scarbrough in his own proper person and the sher of Somerset County (to witt) Joshua Caldwell Gent at the Same day Returned that by vertue of the writt afd to him directed he had attached as the goods and Chattells Rights and Credits of the afd Samuel Waterhouse in the hands of John Newbold twenty six bushells of Indian Corn of the value of Eleven shillings and five pence and three hundred pounds of Tobacco and Likewise that he had made known unto the afd John Newbold by Richard Logwood and Walter Taylor honest and Lawfull of his bailywick that he be and appear before his said Ld |
