73 The City of London Merch.t dec.d at the Time of his Death who Died Intestate (as tis said) if they should be found in his Balywick and them should safe keep so that he might have their Bodys before the Justices of his Lordships County Court of Somerset to be held at Dividing Creek the in the County afs.d the third Tuesday of August then next to answer unto The Reverend Thos Fletcher of a plea of Trespass upon the Case &c.a and that thereof he should not fail &c.a And the afs.d Thomas Fletcher by William Beckingham his Attorney Complains that against the said Nathl Foche James Peirce and John Wood in the plea afs.d as followeth vizt Somerset County ss Nathl Foche James Peirce and John Wood late of Somrst County Merch.ts Admrs of all and singular the goods and Chattles Rights and Credits which were of Hugh Arbuthnott late of the City of London Merch.ts dec.d at the Time of his Death who Died Intestate (as its said) were Attached to answer unto the Rev.d Thos Fletcher of a plea of Trespass upon the Case &c.a And Whereupon the ^same^ Thomas Fletcher by Willm Beckingham his Attorney Complains that Whereas the said Hugh Arbuthnott in his Lifetime To the afs.d Thos Fletcher to Witt on the Twentyth day of August one thousand Seven hundred and thirty one at Somerset County within the Jurr of this Court was Indebted unto the afs.d Thos Fletcher in the sum of fifty Eight pounds four shillings and three pence Ster mony of Great Brittain as by an account hereunto annexed may appear and so thereof being indebted the said Hugh in his Lifetime afterwards to Witt the Same day and year afs.d at the County afs.d within the afs.d Jurr in Consideration thereof upon himself did assume and to the said Thos Fletcher then and there faithfully promised that he the said Hugh the said fifty Eight pounds four Shill.s and three pence Ster mony to the said Thomas well and faithfully would pay and Content when afterwards he should be thereunto Required Nevertheless the said Hugh in his Lifetime and the said Nathll Foche James Peirce and John Wood after the Death of the said Hugh the promise and assumption of the said Hugh so as afs.d in his Lifetime made no ways Regarding but Designing and fraudulently Intending him the said Thomas to deceive and Defraud the said fifty Eight pounds four shills and three pence Ster or any part thereof to the said Thos hath not paid or satisfyed altho this to do the said Hugh in his Lifetime and the said Nath.l James and John since the Death of the said Hugh by the said Tho.s to witt the fifth day of Septemb.r and year afs.d at Somerset County afs.d within the Jurr afs.d was required but the same to the said Thomas to pay the said Hugh in his Life and the afs.d Nath.l James & John since his Death have altogether Refused and still doth Refuse to the Damage of the said Thomas of one hundred pounds Like mony and thence he brings suit &ca Dr Capt Hugh Arbuthnott to Thos Fletcher pledges Depross Jn.o Doe To twenty hogsheads of Tob.o Consigned to you & which by a Moderate Computation & the Sale of 56..12..6 Richd Roe other tobaccos (To) (D.r) |
