August Court    1733             73

    And Whereupon   The said Thomas Nevett by Francis Allen his Attorney Saith that
    Whereas the said Thomas Glaster the Ninth day of September Anno Dom Seventeen hundred
    and thirty two at the County of Somerset afs.d within the Jurr of this Cor.t by his Certain Writing
    Obligatory which the said Thomas Nevett with the seal of the Said Thos Glaster Signed here
`   into Cor.t brings the date whereof is the same day and year did acknowledge himself to be
    bound unto the said Thomas Nevett in the afs.d five pounds to be paid unto the said Thomas
    Nevett when he should be thereunto Required yett the said Thomas Glaster tho Often
    Required the said five pounds to the afs.d Thomas Nevett hath not as yett Rendered but
    the same to him hitherto to Render hath denyed   And still doth Deny and Unjustly
    Detain to the Damage of the said Thomas of three pounds mony afs.d   And thereupon he
    brings suite &ca                                                                  pledges Depros   Jno Doe

       Whereupon the said Thomas Glaster present here in Court in his proper person at the prayer of
    the said Thomas Nevet by his attorney afd is adjudged by the Court here to give Speciall bail to the
    action afd but for want thereof the said Thomas Glaster is Committed into the Custody of the Sherriffe
    of Somerset County there to Remain &.a  the said Sheriffe to witt Joshua Caldwell Gent present herein
    Court in his proper person took Charge of the said Thomas Glasster accordingly &a

             Thereupon the said Thomas Glasster in his proper person Comes and defends the force and
    Injury when &.a and Says that he Cannot gainsay the action afd of the afd Thomas Nevet nor
    Can he say but that the Writing Obligatory afd is the deed of him the said Thomas Glaster
    nor but that he Owes the same Thomas Nevett the afd five pounds in manner and form as
    the aforesaid Thomas Nevett above against him declared

             Therefore it is Considered that the aforesaid Thomas Nevett Recover against the afd
    Thomas Glasster his debt afd and his damages Sustained by Occasion of the detaining of the same debt
    to two hundred and seventy ^two^ pounds of tobacco to the same Thomas Nevett of his assent by the Court here
    adjudged and the afd Thomas Glasster in Mercy &a            afterwards to witt the twenty first day
    of august ann.o Dom One thousand Seven hundred and thirty three the said Thomas Glaster
    present here in Court at the prayer of the afd Thomas Nevett by his attorney afd is Committed into
    the Custody of the Sheriffe of Somerset County there to remain untill the said Thomas Nevett of  
    the debt and damages afd should be fully Satisfied the Said Sherr to witt Joshua Caldwell
    Gent present here in Court took Charge of the said Thomas Glasster accordingly &a
