August Court           1733             71

    In the same Court were Adjudged for her Damages which she Sustained by Occation of
    the Detaining of that Same Debt whereof he was Convict and it was Considered by the Same
    Court that the afs.d Sarah have Execution against the afs.d James by his Default for the debt
    and Damages afs.d &c.a
                                           Att which said third Tuesday of August to wit the Twenty first
day of the same Month Anno Dom One thousand Seven hundred and thirty three being
the day of the Return of the same writt Came the afs.d Sarah Stewart by Francis Allen her
Attorney afs.d and the Sher of Somerset County then being to witt Joshua Caldwell Gent
at the same day Returned upon the writt afs.d that he by Virtue of the same Writt to him
directed took the Body of the afs.d James Shirley whose Body before his Lordships
Justices at the day and place afs.d in the writt afs.d mentioned he had there Ready &c.a
Thereupon the said James Shirley present here in Court at the prayer of the afs.d
Sarah Stewart by her Attorney afs.d is Comitted into the Custody of the Sher of
Somerset County there to Remain untill the said Sarah of the Debt and Damages
afs.d should be fully satisfyed &c.a the said sher to witt Joshua Caldwell Gent
present here in Court took Charge of the said James Shirley accordingly &c.a

    Command was Given to the Sher of Somerset County that he Should take
James Shirley Gent One of the attorneys of Somerset County Court if he should
                               be found in his bailywick and him should safe keep so that he might have his body before
the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of
August then next to satisfie Robert Watson of four pounds Cash and two hundred and thirty two
pounds of tobacco which to the same Robert in the same Court before the Justices thereof at dividing Creek
in the County afd were adjudged for his damages which he had by Occasion of a Certain promise and assumption
to the same Robert by the afd James made and not performed whereof the same James is Convict
&a
                      Att which said third Tuesday of August to witt the Twenty first day of the same

of the same Writt Came the afs.d Robt Watson by Francis Allen his attorney afs.d and the
sher of Somerset County then being to witt Joshua Caldwell Gent at the same Day returned

afs.d James Shirley whose Body before his Lordships Justices at the day and place afs.d in

of the Damages and Cost afs.d should be fully satisfied &c.a the said sher to Witt Joshua Caldwell
Gent present here in Court took Charge of the said James Shirley accordingly &ca
